Hello VJ friends, 

 

I was married to an American in Japan and divorced him in Japan (he's been living in Japan for years). We went through the procedures for marriage/divorce only in Japan, and we didn't do anything in the US. During the marriage, I had never lived in the US and/or applied for any kind of visa. 

 

My question is- 

 

I recently got engaged with an American living in the US and filed I-129F in February. When we filed the application, I included the divorce certificate and family register that mentioned my previous marriage and divorce (koseki-tohon), and I'm wondering if they are enough. Since I didn't actually get married/divorced in the US, I don't have any documents that proof my marriage termination issued in the US...

If you go to US embassy website of japan you will see that US embassy does not require to be informed about marriages.

 

and you can only get divorced in japan if you got married in japan. 

 

Under these rules as long as everything had english translations showing you got divorced and you’re single on your Koseki, there shouldn’t be a problem. The worst case they would ask explanation by the means of rfe.

I was worried because my certificate states "divorce by mutual consent", and I heard that the US doesn't accept that type of case. Maybe I was just overthinking...

The only thing you can do is wait and if you get an rfe. You can find information on Japan’s rules and regulations and explain it. 

 

Im sure it is not a first.
