2018 J1 WAIVER TIMELINE

Hi,

Here is my time line for J1 2 years rule waiver ! My case was based on No Objection Statement.

 

12/28/2017 : sent my document to DOS and Consulate.

01/02/2018 : Consulate received my document (USPS Tracking check)

01/03/2018 : DOS received my document (USPS Tracking check)

01/16/2018 : 'All document was received' Updated on DOS website

01/23/2018 : Consulate sent my No Objection Statement to Embassy

01/30/2018 : Embassy sent my No Objection Statement to DOS

02/06/2018 : 'No Objection Statement was received' Updated on DOS website

02/15/2018 : DOS sent Recommendation to USCIS

02/20/2018 : My lawyer received Recommendation letter from DOS

02/20/2018 : USCIS received my document

03/05/2018 : My lawyer received I-797C (Notice date : 02/23/2018)

03/08/2018 : J-1 WAIVER WAS APPROVED

03/12/2018 : My lawyer received I-797 (Notice date : 03/08/2018)

 

USCIS website is still showing  that my case status is 'Case was received At Another USCIS Office'

It's been 44 days for me and I haven't even gotten a recommendation, which sucks when I see many people getting their recommendations in 15 days or so.

I mailed my DS 3035 package to DOS on 20th Dec, 2017 also Final waiver (stage III) request to Indian Embassy San Francisco.

 I received the No-Objection statement waiver approval from San Francisco embassy on Jan, 16th, 2018 also forwarded to Indian embassy DC.

I received the No-Objection statement waiver approval from Indian embassy DC on 23rd January, 2018. Indian embassy DC, forwarded the No-Objection statement waiver approval copy to DOS also. Department of State (DOS) updated the case status that they received the No-Objection statement on 23rd January.

No Objection Statement Received January, 23 2018
Fee Received January, 09 2018
Form DS-3035 Received January, 09 2018
Form DS-2019 Received January, 09 2018
Passport Data Page Received January, 09 2018
Statement Of Reason Received January, 09 2018

 

On Feb 23rd, 2018, I received favorable recommendation letter from DOS (dated 16th Feb, 2018); same copy also sent to USCIS by DOS.

On Feb 28, 2018, I received I-797C (Dated 26th, Feb) notice of action from USCIS.

On March 19th, 2018, I received I-797 (Dated March 15th) waiver approval notice from USCIS.

My J1 waiver based on No-Objection based.

Hey guys, 

 

I have received Favorable Recommendation, Sent March 12th per DOS Website. I have yet to receive I-797c Notice from USCIS. I am worried because I forgot to put 2 Self-Addressed envelopes with my application, do you think this can delay the process? Have any of you received correspondence back with the same envelopes you sent in with your packet?

Statement of reason No Objection :  Good evening Guys . 

 

Could you please help me to write a statement of reason for my J-1 waiver . My J-1 Visa finished in March 2018 and went back to india for getting No objection statement. By Grace of god i received all my No objection statement . I will appreciate your help regarding writing a statement of reason to get J-1 waiver .

If you did not get government funding and you have the 2 year residency requirement because of the skills list, then the statement is not that important.

 

If you are in the 2nd category, just write that you would like the opportunity to apply the knowledge you acquired in the appropriate type of job to further your career and that there in the US there are specialized jobs that you would not find somewhere else. Something like that.

 

If you got government funding, then you have to write a lot more.

Thanks Coco for your help . Could you explain more about 2nd category . I worked in mayo clinic and i get salary by NIH funded research project but i have 212e rule as i am indian citizen and i completed my J-1 visa tenure for 5 year on March 2018 and now i got NORI from indian embassy to get  J-1 visa waiver .

It depends on whether you got paid by the hospital or directly by NIH. I'm mentioning this because there is a waiver process in which you need the approval of NIH and they have information on their website on how to contact them. But if you were paid by Mayo clinic you might not need to go through NIH. If so, better to say you worked on a project but do not mention NIH on the statement. 

 

Anyway, you'll have to figure that out because if you need support from NIH, you have to do that.

Hi Brazilian! I am also Brazilian and now living the J-1 Waiver drama. Would you, please, help me with these questions??

Were you in Brazil during this process?

Did the Brazilian Consulate sent the non-objection letter via e-mail or by mailing it? They sent mine via e-mail to the DoS but that sounds weird because it is written on the Third Party Barcode Page that they should mail it...
