Background: My Serbian wife came over on a "fiancee" K1 visa, we're not far from petitioning to remove conditions from her green card.  (USCIS screwed up her file royally, but that's not germain to this topic.)

 

What we want to do: Bring her niece over for a visit on a Visitor visa (is that B2?).  She is 23 and a full-time student pursuing a science degree in Belgrade, Serbia.  We will be supporting the trip and stay entirely.

 

My Question:  When I google what we need to provide to the niece websites are listing the same level of documentation that I submitted for the wife's K1, such as letter from bank showing balance over the last year, last three paystubs, letter from employer, etc.  Is this really needed??   On the USCIS site I dont find any confirmation of this.

in order to apply for a visitor visa, she will need to file this, even though you will support the trip is irrelevant, she will have to show strong ties to her country to return home and then it will be up to the CO at the time of her interview if she has presented enough evidence of her plan to return after the visit.

YOU don't do anything for your niece's application. You can assist her in filling it out but it is essentially HER visa application.

 

There is no sponsorship of visitor visas. So you don't show any bank statements or such. You niece must provide evidence of ties to her home country. You can pay for her trip. But she must show that she will return to her home country and not try to stay and live in the US. When a US relative sends in all those documents you were mentioning it looks like they are trying to help the person immigrate to the US, which is not allowed on a tourist visa.

I missed out big time when I was 23, no relatives willing to pay for my Holiday.

I didn’t miss out even with no monetarily advantaged relatives ...I scrimped and saved and backpacked around on a shoestring :) wouldn’t change that experience for anything.

Thanks all.  I should have put in the original post that I understand how US immigration law includes a presumption that the applicant intends to overstay, and that she will need to provide evidence that she will return.  

 

Given that, her main "proof" is that she is a student in the middle of getting a degree, and that she intends to return to finish it.  Does that seem like a strong enough tie in her situation? 

 

Bonus points:  Should she bring documentation from the school to the interview?

CO decides what is good enough, if that is all she has them so be it.

 

Certainly no harm taking her Uni documentation, unlikely to be looked at.

All she can do is try.
