I filed my petition for both parents in February and request for correction came back. I am concerned that i only have a month to fix the issue, and do not know how. They sent it back saying that both applications has the same name but that is not the case. In my country the women takes the first and last name of the husband and attaches -ne after the name. Everything about the two applications are different. Maiden name, birth date....their marriage certificate was attached with translations that reflects the name change from maiden name to the new name. Not sure what to do next....

Write a letter in simple language explaining how people get names in your country. Give examples so they can understand. Or hire an attorney if you want the best advice and don't mind spending the money.

Documentary-qualified 3 weeks ago, and then received a message today saying appointment cancelled and asks me to submit W-4 and Tax Return.

The instruction on the State department clearly says in my case, tax transcript is sufficient.  It is also common-consensus that tax transcript is superior to tax return.  I have no idea what happened but people should just submit all three to not waste time unnecessarily.

I had the same issue. I guess its a new requirement - I submitted the Tax Transcript initially and then they sent an RFE saying I need W-2 for me and the wife and also 1040. I guess this will be a new requirement moving forward.

It depends on what health issue. Most of the applicant let say 80% will go through the sputum test, this is in the Philippines based on my experience too. My mom went back 3 consecutive days to collect sputum. The smear was negative but she need to wait til January 29 for the culture result. Why did she do all this. They saw a scar or abnormality on the xray. They want to make sure what that is. Ex. TB if postive they will treat her there. Negative they will continue the process which is approving his medical requirements to bring to the interview.

I filed I130 for both parents this month. It is definitely going to be a long wait but i am glad the initial work is out of the way for now.

@Air_Borne Given that IR-5 category requires separate I-130s for each parent, are we (were you) able to link both separate 1-130 case numbers to just pay one AOS fee? Or do we need to pay 2 AOS fees considering that the case numbers for each parent are separate even though it is the same one person being claimed in both cases as the primary financial support person?

Concurrently files I-130, I-485, I-864, I-693, I-765, & I-131 for Parents who are present in the US on B2.

@faisalk80 Any updates on your I-130 with concurrent I-485 filing? Was thinking about this route as well but I thought filing for I-485 AOS for B2 seems highly risky. Even if you overcome the hurdle of having immigrant intent on a B2 entry, the timelines seems hard to reconcile- B2 entry is approved for 6 months max stay in the US and I-130 takes a minimum of 4 months to approved by USCIS. Plus having to leave prior to B2 entry's 6 month expiration date means an abandonment of the AOS application. Thanks for sharing how your journey is going.

Hello Everyone!  I am also February 2018 filer and still my I130 is pending (Nebraska service center). I received RFE for late birth certificate registration (unfortunate but common RFE). I responded my RFE within 15 days and since last October 31, my status is showing RFE response received. After 60 days, I have raised service request & called customer service, all are just repeating  of what I can see in USCIS case status check. I know it is a waiting game but is anyone in the same situation or have any idea about the RFE response review  timeline. Thanks!

Hi All,

NVC Accepted all the required documents (AOS, I864, DS-260 and supportive documents) for my parents applcations who live in India,  since my income is low and doesn't meet minimum requirement , so I mentioned my spouse as a household member and my spouse submitted I864A form with other required documents. NVC verified all the documents and sent us 2 email today.

--> In one email NVC mentioned that NVC received all the required documents and accepted all documents

--> In second message email, NVC mentioned : Case FE review note" Based on the income provided on the Affidavit of Support, Petitioner does not meet the minimum income requirement to sponsor the intending immigrants for this case. The consular officer will make a decision regarding this requirement at the time of the interview. For more information, please visit https://www.uscis.gov/i-864p. To avoid delays, an additional Affidavit of Support Form I-864 for a joint sponsor to may be submitted."

I don't know why NVC sent second message email for minimum requirement even if I submitted my spouse income and mentioned my spouse as Household member also submitted I864A ,TAX return and W-2 of my spouse and NVC accepted it.

Do I need to add one more sponsor in the application ? If yes, then how can I add that one member since NVC status shows case completed and scheduling interview ?

Thanks for your reply! Congrats and good to know that your RFE review was quick. Can you please share, which service center your case was processed and the reason for RFE? Because I heard, RFE delay can occur due to high workload in service center or may be due to type of RFE. I am so frustrated on this delay as I saw someone is waiting for more than 3 months after submitting RFE in Nebraska service center!

@arpatel Do you mind sharing the list of documents and civil documents you sent in your original IV and AOS packages? Cheers!

I sent following documents to NVC :

--> With AOS I64

I 864 form of Petitioner

Tax return of 2017

Tax Return of 2016

Tax Return of 2015

Proof of domicile (Copy of US driving license, Passport and Utility bills of my home)

W-2 forms

Any other income proof if you want to mentioned on I864 form

If you take support of your household member's income, then separate I-864A and submit above documents for your household members

Proof of your relation with your household member

You can send only recent Tax Return for 2017 if you don't have TAX return for 2016 and 2016.

Marriage certi of petitioner

Marriage certi of Applicant

Birth certi of Applicant
