Hi everyone, wow, it's been a while since I've posted on this site but I'm so grateful to be able to do so as this platform has helped me EXPONENTIALLY from day one (filing my K-1 visa application) to now (removing conditions).  I hope you all can help once again and please forgive me if this question has been asked multiple times.

 

I filed my application to remove conditions rather late unfortunately. The recommended timeframe was 90days before expiration of the Greencard but I didn't file until maybe 30days before, due to not being able to come up with the filing fee until then. Now, it's been a little over a week  since I filed and I'm just waiting to receive notice that it has arrived etc. My greencard will be expiring on Feb 20th and so will my Driver's License :( Obviously, this puts me in a very scary situation since i know I need my license in order to get around and I doubt my application will be approved before then. So, my question is, what can I do? Is there some kind of temporary license I can get? How do I go about that? Or is there some letter I can get that states I'm just waiting on my approval? Because I'm also job hunting and have received a few callbacks. I'm sure if I am hired they will be concerned that my greencard will expire soon.

 

Any advice any of you can offer would be greatly appreciated. Thanks.

My wife and I are going through this in Arizona. Initially her license expired on her green card expiration date, when she got her NOA/One year extension we took that to the DMV and her license then expired one year past the expiration on her green card. Recently, we got her I-551 extension stamp in her passport for an additional 6 months, since we are still waiting for her ROC approval and are past the extension. We then went to the DMV with the I-551 stamp and now her license expires in July. 

 

It's not always easy at the DMV, we have been pretty lucky in finding people who know how to handle the different extensions. When she get's her 10yr green card we will go back to the DMV for the next license, which in AZ should expire at the expiration date of her new green card.

Oh, so are you saying that when the NOA 1 comes it automatically comes with an extension? I'm glad everything worked out well with your wife :)

Have a look at the link above.  There is also a link on that page to book an appointment online.   When you go to your appointment, explain your situation and take your documents.  They will pop a stamp in your passport to extend the expiry date on your green card :).

If you just filed you will need your NOA witch is your extension letter for one year on your green card , you will need that letter to renew your license without it I don’t think you can renew it , usually that letter comes 2 weeks after you send your package , I saw someone telling you about a passport stamp that usually it’s done when you approval of removal of conditions hasn’t approved and you need a proof for travel renew license or work. To get that stamp you need to make an infopass appointment one month before your extension letter expires.  so in your case you don’t have that letter yet. In my opinion you need to wait to get that extension letter NOA before go to DMV.

Yeah it's pretty straight forward and easy if you follow the process. So you should  get the NOA1 almost any day now.

Went to the DMV (DDS in Georgia) with my NOA1 in hand and they said this was not the right letter and they wouldn't renew my license! The person who was dealing with it wanted to renew it but he manager came over, took one look at it and said: "They're all coming in with this letter but this isn't the right letter." I wanted to cry because my license is officially expired as of today. I thought this was the only letter I needed (along with my supporting documents) but the manager said I need an I-797-C? Is she correct? Has anyone else needed this? Please share because I'm freaking out, I need my license.

Another perfect example of the incompetence and useless employee competition between the DMV and USCIS. And from a manager too? :rolleyes:

 

Suggest you try a different branch of your state DMV and hopefully get someone competent.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Thank you for suggesting this! I was surely in a panic yesterday as I drove away from the DMV with an expired license after being given the wrong info and told I didn't have the right document to renew. I drove to another DMV location further away, still a little nervous that I would be told the same thing, but nope! They did it for me with no questions asked, no calling a manager over, no looking at my paperwork strangely. Although the wait times were much longer at this location, once I got to the counter it was literally, "in and out" with no issues and I now have my license renewed! I feel terrible for all the people the lady at that first DMV is turning away so I will definitely be writing a YELP review about it. It's sad when people are so confident in their ignorance on such an important issue in people's lives.

Nice to see you got it done !!  I did my renewal with that letter without issue , they really are uninformed about the extension letter it needs to be addressed because that can affect like you said peoples lives.

Mileage varies depending on the state.

 

Had to do this in Nebraska and they did not recognise the 1 year letter extension.

I had to get an Infopass in Omaha and get the temporary I-551 stamp in my passport. 

 

Once I had the stamp it was fine. If you get someone who argues with you and you have the temporary stamp, ask to speak to a supervisor.

The NOA-1 is the legal way to do this. You just need to find someone willing to get "the book" out and look at what code they need to enter into the system (it is different for every document). But as most of them do not want to turn around and prefer to use a yellowed piece of paper written 10 years ago and taped to a monitor, you may need to convince them. The have a book, it has the code, the code goes into the system and presto they extend it for a year.

Already not looking forward to going in again next week.
