Hey I live in a bordering city, Tijuana and am hoping someone with some experience can guide me.

 

I have spoken with a few lawyers and each tell me different things. One says to marry first in mexico and apply for green card. Other says not to marry and do the k1 route. Is there a definite yes or no answer for us to either get married or not in Mexico?

I would consult with a lawyer if you have a complicated situation.

 

But since you're not married, K1 would be the quicker route to bring your fiance over. The estimated time from application to approval is about 10-11 months right now.

 

The marriage visas tend to be cheaper, but can take a few months longer. Here's a better comparison:

Please read the guides on this site and compare the two options - there are advantages and disadvantages to both and no one can tell you which is the correct choice for you as everyone's circumstances are different. It's a very personal choice that you and your fiancé will need to make together.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

I'm still researching. However I see that Direct Consulate option. If we marry in Mexico, can I then apply for residency in Mexico? And then do the DC option? I've been living in Mexico for just under 3 years now, while working in the USA (us citizenship). I'm hoping someone with Mexico experience can chime in.
