Hi All,

 

After my petition for I-797C has been accepted (NOA1) my photo album has been returned back to me from Dallas TX with the following letter: "We are returning this item you sent in support of your application/petition, as it is a format we cannot place in your file folder for review by an officer during the adjudication process." 

 

Does this mean that my supporting evidence will be not attached to the case and effect my case decision?

Can I request to add my supporting photos to my case? And how can I do it?

Does anyone had the same issue and how it was resolved?

They can not scan a photo album into their system, You should of sent just a few pics, or of made color copies of a handful of photos.

June 5th,2019   USCIS received my response on the  NOID// Addressed the NOID myself, No lawyer ever used in case.

July 1st, 2019  10 YEAR GREEN CARD APPROVED

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

July 11th 2019   Green Card in Hand

Why would you send a actual photo album? That is way to many pictures and they aren't able to scan them in to the system in a timely manner at all. When I did it I had 4 photos per page and I sent in 3 pages worth of photos already on a photo paper. You can do this online for quite cheap actually, and it doesn't take a lot of time at all, and they will send them directly to your house. I did photos of us together having fun, me with her family, pics of all of us having fun.

You could call USCIS and ask a representative.

Part of the problem is that once a case goes to the CSC it's really hard to find the case, or the adjudicator, to attach those files to it. At this point you may just have to wait for a RFE.

Wait for an RFE, they will ask for evidence and when they ask you can send it,

 

Photos are secondary evidence after all, I am guessing you also sent other evidences such as passport stamps and boarding passes.

So if those evidence doesn't suffice they will send you a request for the evidence, thats when you should send it.

If I was you, I would make colored copies of maybe a dozen pictures, write your full name on the back and with your Case number assigned by USCIS,  do a cover sheet, explaining what you doing and ask if they can put in your file.   Don't hurt to try.  maybe enclose a copy of your NOA 1. 

 

Cant guarantee this will stop you from receiving a RFE, but don't hurt to try.

 

What visa are you petitioning for?  K1, Marriage?

You sent a whole photo album? Don't even send regular photos, just copy them on regular printer paper (2 photos on each sheet of paper, then you can write your own descriptions/dates/names under the photos). That fits fine in their folder, takes less space than regular photos too.

 

If you have enough evidence of the two of you meeting in person within the last two years aside from the photos then don't even bother sending photos back to them. They're only secondary evidence anyway and tons of people get approved without any.

I sent USCIS a letter while my AOS was pending. It wasn't regarding an RFE or anything like that, it was just a request about updating my name in their system. Several months after I had sent the letter I had still not heard anything from them or seen any changes on my online case status, kinda figured they never got my letter - or got it and threw it away/didn't add it to my file.

 

So when I went for my AOS interview I was SO surprised to see my letter in the massive folder that is my immigration file, on the interviewer's desk, right in front of me. It had actually been matched with - and ended up in - my file while my case was still pending at NBC, and was then shipped along with everything else to my local field office where I had my interview. 

 

So yes, I definitely believe they try to match it if possible, they sure did in my case. If you decide to send them more photos, make sure to add every single little bit of information about you and your petition in the letter, such as receipt number, both yours and your fiancé's name, address, phone number - everything you can think of to make it easier for them to match your letter with your file.

I agree! At this point, it doesn’t make any sense to send anything and you can cause a delayed on your case without need.

 

If you are applying for a k1 visa, the 129f form request proof of meeting in person, not proof of ongoing relationship. If you sent secondary supporting documentation like passport stamps, flight tickets, reciepts from hotel, restaurants etc that place both of you in the same zip code, it should be ok.

 

Pictures are good proof but is not the only one. Just wait and see. If you get and rfe requesting for more proof, send a FEW pictures. If your case goes ahead without an rfe, take the album to the interview when you really going to need it

When I first sent in my K1 I put all my evidence in a flash drive.  I thought it would be super simple/easy.  Within days they sent it right back with a similar letter you mentioned.  (Oops!!!)

We just waited for the RFE which, at the time, didn't take too long.  Then when it came in, I just sent everything PRINTED. (Definitely learned my lesson there.)

 

I would recommend just waiting for the RFE.  I'm assuming you sent more evidence than just photos?  Perhaps you already have what you need for support?  USCIS processes thousands of cases and if you're sending stuff without their request letter for them to reference, there's no guarantee  that it will make it's way to your file.

Photos are secondary evidence. Yes that is too much to send.

What we did was honestly the cheapest way.

Printed out the photos (about 10 in all) with handwritten captions at the bottom of time/location/etc on 8,5" by 11,00" regular paper. Some were black and white, others in colour. LOL. They liked those because my fiance said he saw those pictures in the files the VO had on her desk
