It's very unlikely you will be applying for a K-3. 

 

You are at the petition stage right now. What will most likely happen is that the I-130 will be approved and the I-129F administratively closed. The I-130 will then be sent to the NVC for CR-1 processing. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Is that means I will have to wait longer ? 😢 specially my case at Nebraska service center too :( 

i know the difference between K3 and CR1 is to process the case while am inside the US with my husband living together, so what’s gonna be the case now and how long it’s gonna take ?

So it's taking around 9 months for Nebraska to approve I-130s. Then there is the NVC stage which is around 3 months. Then the interview. So it's 13-14 months in total. The wait is the same for everyone. Nobody has it any easier. The wait hurts but it's all worth it in the end.

A CR1 does not require you to be located in the USA.

If you’re in the US you don’t need to apply for a visa, you apply to adjust status.

You have misunderstood the question. The OP was inquiring about K-3 which enables the spouse to adjust status in the USA. Instead they will be doing the CR-1 outside the country and that is the OP's unhappiness - she wanted to be together sooner so she wanted the K-3. Best to reply to questions that only relate to visa types that you have an understanding of.

And that's the OP's point. She wanted to do the K-3 so that they could be together sooner and adjust status in country. But it's not going to work as this path is as good as closed.

Thank you for clarifying things out, although it so harsh, but I guess we have no other option. It’s so painful what they are doing to families, i wonder what happen to human rights which they always talk about it . Absolutely unfair 😢

Immigration isn't a right. They aren't "doing anything" to families. We all had to wait, yes it was hard, but you get through it and persevere. 

 

It's not a human rights violation to make people wait for a visa. Go to a country where they actually have human rights violations and then complain about the long process. We have to keep America safe and proper vetting is important.

You are looking at it the wrong way. It is not immigration's intention to make families suffer. It is that there have been a lot of petitions filed recently and they are getting behind. Plus they have to be sure the cases go through all the proper checks. IT takes time to do millions of checks of applicants that submit tons of evidence from all over the world.

 

Not to even mention that immigration doesn't get a ton of funding from the government (which is why the fees are so high) to expand.

 

The wait is because it takes time to do their job. Sometimes the cases get approved in a reasonable amount of time and sometimes they get backlogged like they are now. It is like when a restaurant has a busy night; instead of being seated immediately you have to wait a while.

Another thing, is to look at the history of the K-3. It was created years ago when the CR-1 process took several years, vs 12-14 months now (average times). The K-3 was originally helping spouses with that years long wait be together sooner. Hopefully that information will help give you some perspective.

04/15/2013 INFO-PASS appointment

05/01/2013 NOA2 sent petition approved

Actually the K3 saves you at most a month, maybe two depending on the speed at the NVC.  The petitions take about the same amount of time, or longer.  6-10 months is average at the moment.   But the K3 costs twice as much and considering the current AOS times, about twice as long to green card. About 0.3% (or less) k3 are issued to IR1/CR1.  Majority do not make it past the NVC. Its an inferior visa and has been for 6 or more years.
