Hello,

 

I am from Spain and I guess the wording of the criminal offenses section of the K1 petition document is confusing me. In college, I had a night I went out and made some stupid decisions. Because of it I ended up arrested and being charged with underage drinking and public poisoning. I paid a fine and did 20 hours of community service.

 

I know that in section 2.c. of other information I can say no since I've never been arrested more than once. However, am I required to say yes in section 4.a, which reads as follows?

 

Have you ever been arrested, cited, charged, indicted, convicted, fined or imprisoned for breaking or violating any law or ordinance in any country, excluding traffic violations?

 

My guess is yes, but I wanted to make sure. Also, if it happens to be that way,  do I just need to explain the situation or actually get paperwork for it?

Yes, the last thing you want to do is not tell the truth. State Dept's (or their equivalent) have data sharing agreements. The will also have police & court information and if you omit it will just make things more difficult.  I would say you didn't make a misstate. A mistake is when you grab the wrong key or flip the wrong light switch. You made a serious mistake in judgement. Don't sugar coat it, own it. You learned  have not repeated.
