My wife came from korea on a visa waiver (expired now), got married and will be mailing the AOS forms soon (I-485, I-864, I-130, I-131, etc).

When can she fly domestically without an issue?  Is she fine once the forms are accepted?  Does she have to wait for the I-131 (advance parole) to be approved or should she just wait for her Green card?

We would like to travel domestically before she gets her Green Card.

You are good to go as long as you get the NOA1 where they received your package.

Like others said it's better to wait for the NOA1 and I'd say after she receives her NOA1 she can go to the BMV and get a State ID or Driver's License (validity for 1 year) and you can use that ID anywhere and don't have to carry passport everywhere.

according to NJ motor vehicle website:

If you are not a U.S. citizen, the identification verification still applies to you, but you can also use one of the following as a primary ID:

  • Foreign passport with INS or USCIS verification.
  • Current alien registration card.
  • U.S. re-entry permit.

Can she just show them the NOA1?

how soon can I expect to received NOA1?  like a few days after they receive my package in the mail?

NOA1 mail should be received within 2 weeks after any application is received by the USCIS

She will have to take the following:

Passport

I-797 (NOA1)

SSN

I-94 Arrival/Departure record

Address Proof

Thanks again.  She doesn't have a SSN yet but according to the NJ 6-point ID verification requirements, she will be ok with I-797, our marriage certificate, and utility bill.

So she can just use the state ID to travel domestically?  I won't ask for her foreign passport?  I guess there is no reason to since her name/photo will be on the state ID matching the ticket.

She overstayed on her visa waiver, is that still ok?

I thought she was applying for driver's license...anyways all she needs is a Passport or State ID or US Driver's License and its better to keep a photocopy of NOA1 wherever you are travelling.
