US Citizen spouse withdrawn the petition while LPR wife is out of the country

Or you go and talk to a lawyer on her behalf may  they can file a motion or from uscis to have her back here with no issue she may need to sign papers but that can get to her by express mail and she mail back the same way. I hope it all work out for her.  Things are not like they was before as everyone sees Trump is getting rid of us slightest thing under Trump now I don't know. How long has she been out?

her green card is valid until her case is decided. her husband withdrawing support simply triggers uscis to send her a rfe for the divorce decree because she will now be given the chance to apply for a divorce waver.

 

also it is her petition. not her husbands, he simply signed that they were still married his withdrawal of that does not cancel the petition.

 

also what petition could a lawyer file beyond what she could do her self?

i just talked to her on fb messenger video call, she is crying and it was heavy feeling on my part seeing her on that situation. She said, she did not signed any papers to withdraw her petition, she was surprised on the email that she got from USCIS, she will rebook her flight as soon as possible so she can return and hoping there would be no issue and allow her to enter given the situtayion. She is trying yo reach out to her husband but the husband already blocked her from fb and not responding from text message even on her phone call.

That will be best for her to return. If He s blocking her she will not get onto him is for to just try to come back and deal with it

We don't what she did but it sounds like she did something pretty bad to make her husband withdraw the petition.

That's what i told her but she needs too because she needs to get her things and move out from their apartment. I will be with her in that situation so I would know she's safe along with cops I guess in case the husband act violently.

Yes call and ask for a police office to help retrieve her things. He will not act out with them there but he may if it's just the two of you.

Perhaps the OP is just supporting a friend? Or perhaps he is boning her? Perhaps the husband has mental issues, or has been having an affair and this is a good distraction technique and attempt to get rid of the wife at the same time?

 

Or, just maybe, perhaps it is none of your - or anyone elses - business what happens in a marriage, and they came here for some good immigration advice.

If I were the wife in the situation, I think initially I would be ashamed at how my husband had treated me, absolutely shocked since it was still so fresh, perhaps in disbelief that this was happening at all, and therefore maybe not so quick/verbally able to give out details in my stunned state.  Especially if I had no clue this was even coming in the first place and under the belief the marriage was fine and hunky-dory considering the husband was acting as normal right up before I left the country.

 

That's just my opinion on how I would react, personally, based on the little details the OP has chosen within their right to make us privy to.
