My fiance came to the USA  on a K1 visa from the PHillipines 3 months ago.   We were married 2 months ago.   We are now doing the paperwork for a "change of status".   Can I use the same forms that I used for the K1 visa, for example the "affadavit of support".  My jobs and income have changed.   Thank you and regards,  Chris in Florida

This is your guide.

She won't be allowed to work until she has her work permit (i-765; Employment Authorization Document). As of right now, the processing time is 3 to 4 months. Same goes for her Advanced Parole (I-131). If she leaves the country BEFORE her  AP is in the mail, her AOS will be abandoned and you will have to apply for a CR1 visa for her. The actual Green Card process usually takes 12 months. Some people get the card sooner, some people later.

 

You will have to use a different Affidavit of Support (I-864).

 

The total filling fee for the I-485, I-131 and I-765 is $1,225.

I always like including the newest forms. So if it's possible, get new forms, more recent dated. Go though the documents 3 times one day, 2 times another day and then another time the third day! Just a suggestion

The AOS is completely different than the K1, so make sure you follow the guide for that.  A lot of the information may be similar, but there will be more forms as well as a more in depth and binding affidavit of support (I864).  As LUAL stated, always go to the official USCIS site to get the latest forms, and make sure you check everything over many times and make a couple of copies of the entire package prior to submitting it.
