Just thought I'd contribute this to help others...

 

I just travelled back to Europe on Advanced Parole for a two week holiday with the missus. I have an active adjustment of status case based on my marriage to a USC.

 

A lot of info out there suggest this is somewhat risky, especially with an overstay on your record (mine was three years).

 

My lawyer assured me it absolutely was not risky and that many of her clients do this.

 

She gave me some documentation to bring in case they asked questions. It was just receipts of our adjustment application and a cover letter explaining.

 

At customs, the officer took my passport and said we will need to get this stamped.

 

I was taken to the area where they send people for check ups, grilling, etc. And waited there for about 20 mins. I wasn't worried at all as I knew this would happen.

 

20 mins went by and then an officer called my name, handed me my passport with a stamp in it and said "you're all set."

 

That was it.

 

Bottom line: do not be worried about utilising your AP - unless you have a very specified reason not too, e.g. Complicated case or criminal history.

THANK YOU. I am panicking at 1am and even though I know nothing is guarantee I feel so much better seeing someone has some positive info. Everywhere you go nowadays people tell you don't risk leaving or you won't be able to come back. Damn Trump

You have nothing to worry about.

 

Congrats on your ability to travel on your AP. I think it also depends on your country of origin and where you are heading to. I might be wrong in this assumption.

I too have an overstay approaching three years and was recently approved for my EAD/AP combo card (yesterday, in fact). This news does make me feel less uneasy at the prospect of travelling before getting my greencard, but I'm still debating whether to return to the UK for one of my best friend's weddings in a little over a month or to forgo it and hope my AOS is approved before Christmas.

Go.

 

Ive done it twice. There are no issues.

 

You will get taken to secondary inspection to wait while they run the numbers on your EAD/AP card to check you have an active case.

 

Then, they stamp your passport and hand it you. No questions asked.

 

My lawyer assured me before I went that she has tons of overstay clients that travel on AP and none have had any issues.
