I had filed my I 485 in August of 2016 in I immediately received an RFE stating that the financial documents were inadequate I sent in what was  asked for. Everything went well and on January 6th my interview was scheduled for Feb 9th 2017 immediately after I got the notice  I had to go back to India as my fathers health had depleted to a critical stage thus I requested a travel document and got it expedited and also requested a rescheduleing of my interview as soon as I got my travel document I left and later on I received the email that my request to reschedule has been granted, Now after multiple inquires which came out stating that I have been rescheduled and will be given the next available slot  on June 15th I check my online update and it states my application has been denied.

 

Could it simply been an issue of miscommunication among the offices or are there other reasons associated as well.

Do you mean July 15th? Because otherwise you missed your interview

Oh I understand. Sorry I read it wrong. The best thing to do would be to call them or wait for the notice for denial to arrive.

OP, did you ever receive notice about what date your interview was rescheduled for? If your initial interview was back on February 9th, it sounds like your rescheduled interview time should have happened already and you missed it and that's why you've been denied.

Jan 13th 2016 - Mailed our reply to the 221(g) to the US Embassy, received and CEAC updated the next morning


Jan 20th 2016 - Embassy require more in-depth info on asset for i-864


Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning

April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:

OP, did you ever receive notice about what date your interview was rescheduled for? If your initial interview was back on February 9th, it sounds like your rescheduled interview time should have happened already and you missed it and that's why you've been denied.

I never received any interview notice except the original one that was on 9th February. I was thinking on the same terms thus I did put in an inquiry request yet the out come was the same where it stated that the request has been granted and waiting for an available slot.

You are not the first person to be denied after re-scheduling an interview.

 

It seems that the communication between the different offices is not very good.  When one office grants a re-schedule, they are not telling the interviewing office.  So when the interview date comes and goes, the interviewer just assumes that the person didn't show up and denies the application.

 

It is always suggested to not re-schedule interviews, unless absolutely necessary.  In your case, it was probably the only way. 

 

Contact the interviewing office ASAP and let them know that you were granted a re-schedule.  I'm sure that you will need to provide some proof (letter/email) that shows that your interview was re-scheduled.

So in case it is because of the miscommunication would i need to appeal it or simply call USCIS or get a Infopass and this can be sorted. 

Also, would my case then can be considered for expedite request as its a mistake on their end?

Agreed. I would go the first available Infopass and explain the situation. Most likely they were not notified of your attempt to reschedule and so marked you as a no-show, resulting in an automatic denial. This happens far more often than it should.

I just talked to a tier 2 officer and she said I need to wait for the denial letter for the reason as it doesn't make sense that on May 18th the field office would respond to the inquiry by saying that they are waiting on a scalable slot and the on June 15th send a denial.

It's possible that the RFE response you sent them was deficient, which can likewise result in a denial.

 

I guess you'll need to wait for the letter to find out.

I think so as well. The thing that is beyond me is that of it was a issue with the RFE then why did they schedule an interview in the first place.

My gut instinct says it's more likely the interview rescheduling, because that happens so often I've lost count of the number of posts I've seen here asking about it. It's a lot.
