hello....i came to the USA in 2011 on a student visa (F1). I have also completed my studies in 2016. In 2013, I was arrested for petty theft and possession of marijuana (1 gram). they dismissed the theft with no punishment at all. However, i ended up with a conviction for the marijuana charge. in 2016, i was arrested for tampering with evidence but the case was fully dismissed 2 weeks later due to not being billed by the jury. so all in all, 2 dismissals and one conviction. After my studies, i overstayed for 3 months then got arrested by ICE and was granted voluntary departure. Now, i would like to visit the US to visit my father's grave . he passed away there. is it possible to get a visa somehow? i did not overstay for more than 3 months. i would highly appreciate your help. thank you

Honestly I doubt you will get a visa. Even without a ban everything you have done really lowered your chances.

Given your history, it's unlikely. However, what's your job, financial and living situation now? Are you able to prove your ties in your home country if you were to give the visa application a try?

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

Well, there's no harm trying. Just know that you have a higher chance of getting denied. Make sure you can convince a consular officer of your strong ties in Kuwait (family, work, financials) and overseas travel history. All the best! Condolences to you on your father's death.

If you're planning to go down the CR-1 or IR-1 route (spousal visas), you and your partner will need to prove a bona fide marriage that's entered in good faith. Marrying a US citizen guarantees nothing unless you can satisfy and convince USCIS.

 

One more thing, don't try to enter the US on a B2 with a pre-conceived immigration intent. As it is, you have enough negatives on your records so you don't want to add immigration fraud to it.

Highly doubt he will ever get a B2, hopefully too, but I guess he can try.
