Good Afternoon All,

 

I did not find any similar Topic so I thought it would be important for people to have some sort of guidance on what they are doing from past experiences. My 2 years GC expired in September 2016, I have applied for the ROC in July 2017, received the NOA in July 2016, and received my Biometric Processing Stamp at my biometrics appointment on 8/2/2016. My questions is:

 

When do I actually NEED/HAVE TO make a infopass appointment? 

 

We all know that info pass appointments are useless the most of the times and lengthy all the times, however there are cases that in order to stay within the rules, you have to make one but I am not sure when. Is it withing 30 days from your Biometric Stamp date or what?

If anyone could share their experience and/or answer the questions, I think it would be beneficial for all the ROC applicants.

Well...

If you feel your case is taking to long and you aren't getting any where with the USCIS phone line
When you feel that talking to a person in person will help
If you feel there's something wrong with your case and you aren't getting any where with the USCIS phone line


Really, if you ever feel like you need help, you can make an infopass appointment.

You can have an infopass appointment when ever you want, there are no rules. Treat it more as a customer service you can walk into on your scheduled time.

I understand we can make it whenever, what if I don't and arrive to October 2017 with no news from USCIS... what would happen?

 

When is it that my current status (waiting for ROC with a stamp) expires?

If you don't make an infopass appointment and don't get a new stamp, showing your still waiting. You will be out of status.


I guess I took your post as "When are infopasses used?" instead of "What do I do if my I-551 extension expires while waiting for ROC?" since while they both are about infopasses, you'll get two different answers.


In the case that your stamp is expiring, then you make an info pass appointment for a new stamp. They will give you a new one since you are waiting for ROC, but yes, you have to make an appointment and go there to get the stamp. It's not recommended to wait until the expiry month, maybe go in late September for the new stamp.

Wrong wrong wrong.

 

The extension letter and/or stamp serve as proof of your status - they do not dictate your status in any way.

If you have no need for proof of status (travel, DMV, HR, etc), then there is no requirement to get a stamp.

 

 If you have filed your I-751 on time, your status remains unchanged with all the rights and responsibilities as a LPR, until such time as USCIS or an immigration judge terminate your status, or until you are approved.

Until that point your status is unchanged.

As above, it doesn't. The proof of your status expires but your status doesn't.

 

You can make info pass appointments 14 days in advance - they are released by or at 00:01 Mon - Fri for the corresponding day two weeks ahead. They will only give you a stamp near or after the expiry of your initial 1 yr extension - 30 days before is often mooted but it is not a hard and fast rule (I personally had one done 50 days before expiry), but unlikely they would give you one say, six months before expiry of your initial 1 yr extension, unless you had lost the letter itself.

To make the appointment you go HERE, and you will need your A#, and your receipt number to hand.

Show up with your passport, your extension letter  and your expired card (which they may or may not retain) and it shouldn't take long.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

 I-751 Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

I guess I have always considered having proof of status incredibly important. Having the status is great and all, but I don't think any one would recommend not carrying proof on them. At least here in Texas where they passed a bill against sanctuary cities, and a regular traffic stop can now become a "prove your status".

i heard about TX passing that bill and i'm sorry for you and all the people affected.

when your GC is valid , that is your proof of status.

when you get your 1 year extension letter that  is your proof of status

if after the year you haven't heard from USCIS you can make an infopass appointment and tell them you need some sort of proof. they will most likely stamp your passport and that will be your new proof of status.

 

the best you can hope is that your case gets approved before your extension letter expires and you get your permanent green card

Hi, the I-797c is only your letter for your biometrics appointment & the stamp is only the proof that you attend the appointment & has nothing to do with your status, the first letter that you received the I-797 after you sent in your application to remove conditions is your extension letter as it says so in the first paragraph of that letter.

It extends your green card for an extra year from the expiration date on you green card.

I have a question. I am travelling twice, once to Western Europe and once to Africa. Both within the validity of the NOA1 Letter for ROC. However, I am concerned about the Africa trip. The airline personnel sometimes dont understand these things. Will it be possible to get a stamp?

It is only needed for a flight back to the US. Not from the US, or any other flight while outside the US.

 

Bookmark or download the document found HERE and remember page 38 for use if you encounter a clueless agent.

 

 

Are you flying directly from Africa to the US? Euro staff at airports with direct flights to the US tend to be more clued up, and they can always make a quick call to their back offices to verify.

Chances are if someone doesn't know what the extension letter is, then the stamp would be equally as confusing.

No flying from East Africa to Amsterdam, then on to the US. However, the carrier from East Afica is Kenya Airways. The personnel sometimes tend to not be trained n these different documents. So lets hope it will be ok.
