Ok, we are working on gathering evidence and documents for adjustment of status. Now that we are married since last week, does anyone know the time frame of when adjustment of status needs to be filed? Does a new time frame begin separate from the 90 days to marry once k1 holder enters the US? I don't want to miss some deadline that makes him have to go back home LOL. Can he just stay now as long as we are working on this next paperwork hurdle?

 

He has been here almost 1 month. We are applying for his social security number this upcoming week and turning in work visa with AOS packet.

 

He has been added to my apartment lease and we have a copy of it to file. Is that enough proof of residency or will a bill be needed as well?
 

We are ready to rock but a bit confused at the same time about the times. Am I doing things ok?

You're fine. the 90 days was to get married upon entry. As long as you did the marriage you technically can file 2 years from now. You fullfilled the requirement of the 90 days.

 

Soon as you get all the paperwork in order and fill out all the forms for the I-148, AP and EAD(if you wish to file these too) then you can finish your packet and submit it to the Chicago Lockbox for AOS.

 

Just use the guides here on VJ and you'll be fine.

I agree with the above. I will also add...

 

You only have legal status in the US until the I-94 expires (90 days after entry). Once you file for AOS, you are in a period of authorized stay while that case is pending. If there is a gap between the I-94 expiration and filing of AOS, that is a period of unlawful presence. It's unlikely any action would be taken, but technically you could be deported during that period. Once you file for AOS and authorized stay begins, that risk no longer applies and the overstay is ignored.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

All good advice so far. I just wanted to add it's fine if you don't really have a lot of proof of relationship/residence/etc. Really, the important document is the marriage certificate as it shows that you complied with the requirements of the K1 visa and are now eligible to file for AOS.

 

USCIS knows that with marriage happening within such a short time frame, most couples don't have enough time to gather much evidence. That will be much more important during ROC. It might be a good idea to start looking into that now so you will have an idea of what to look for and aim for in the next 18 months or so.

my husband entered the US 2/26/17

 

We married 3/22/17

 

90 days is up in 3 weeks 5/26/17

 

we have been putting it off because i've been catching up from the wedding and working loads of overtime.

Now that I am caught up, we are ready to get this ish done.

 

Mailed off priority 2 day mail to chicago 5/15/17

Hopefully filed by the following week....

 

ARE WE DOING OK HERE?? I feel seriously stressed out about this right now and don't want him to get deported because of some technical time frame lol

There there's no time frame requirement to meet when filing for AOS, though it's obviously best that people do it asap. If you married within the 90 days of entering in the US (and you did), then you complied with the terms of the K1 visa. And now that you've filed for AOS, once you get the NOA1 for that, you're good. No need to stress. :)

I entered on a K1 from the UK, I am married now. I am about to file for my AOS. But my question is, before I came to America I had my medical and completed all vaccinations required to enter america. So do I still need to file a I-693? 

Also I am still within 1 year of completing medical and vacations. 

If anyone could help me out it would be great.

You do NOT need a new medical - the one you did for your visa is still valid.

Relax, you have done everything right, when the file is received and scanned then he enters a period of authorized overstay ( if you are stressed about the possibility he might get stopped just get him to carry the NOA1)

 

Dont panic about proof of relationship, I sent exactly what was asked for (no additional proof) and my AOS was approved without interview.  If you do get an interview just take whatever you have collected with you :)
