Sure you can have a joint sponsor.  However, remember that whoever the joint sponsor is the income must be above the minimal poverty level amount based on the number of individuals that joint sponsor's income needs to cover.  Research this on VJ further to provide you wit the knowledge you need to proceed further.

Yup I have read about the minimal poverty level amount also in this forums. I'm just really confused on this I-864. Thanks for your help!

I sense some confusion here.

 

It doesn't matter how much he is making now. USCIS wants to know how much he will make when you are in the US. 

Or that he has enough cash or assets until he finds a job in the US.

 

Is his employment going to continue once you guys hit US soil?

I.e. will he work for the same company and just relocate him?

If yes, then his income is relevant. If not, then we go to assets. Does he have x3 the 125% above poverty for 2017?

(Car, house, cash, stocks, bonds?)

If yes, you are good. If not then you start looking for a joint sponsor.

2011 - Met hubby online and became friends
Early 2013 - Confessed our love for each other * Late 2013 - I got pregnant with our daughter
2014 - Our baby was born in Athens, Greece and completed our family. We now have two boys and a girl!! 2013 - 2015 - Looking for jobs in Greece, none were available (due to socioeconomic crisis) 2015 - Decided only way to feed our family was to immigrate and started the process December 2015 - Got married (Greece has a LOT of red tape for foreigners marrying Greeks)
January 2016 - Finished gathering all documents and getting them translated
* * DCF in Athens, Greece * *

28th January 2016 - Finally filed I-130s
29th June - ISSUED!!!!!!1st July - Visa packages and passports delivered to DHL.4th July - Visas in hand! CU in two weeks USA!!
19th July- POE Detroit. All went well!! (excluding our screaming, jet lagged toddler!!)

 

After Arrival in the US

September 2016 - Hubby is diagnosed with congestive heart failure
October - February 2016 - Battle with drug use, overdosing, bringing home a tiny paycheck

March - July 2017 - I am working 80 hr weeks to make ends meet. Discovered hubby's affair. Still overdoses and is hospitalized. Has quit working all together.
July - October 2017 - Marriage counseling. Revealed hubby has "several" mental conditions. Is started on several mental meds.

October 2017 - Got accepted for a college course. Got better job to help raise my kids.

October 2017 - March 2018 - Situation at home is toxic. He files for divorce.

July 2018 - Divorce is final. I have full custody of our daughter.

 

ROC (GC expires July 19th 2018)

July 16th - Package for ROC is delivered to the CA service center (divorce waiver).

August 30th - NOA1 received with 18 month extension (fee waiver approved).

March 28th 2019 - Biometrics

August 8th 2019 - Case Approved No RFE No Interview - 10 year GC in production

N400 (Online - Detroit, MI office)
June 6th 2023 - Applied for naturalization under 5 year rule.
June 7th 2023 - Application received/Biometric will be reused.
June 16th - Interview scheduled.
July 27th - Upcoming interview.



**Our DCF journey to an IV took 5 months and 1 day from turning in the I-130 to getting "Issued"**

Hi Ysai, hope this helps your situation.   If your husband is a US Citizen, but living in the Philippines for too long years and doesn't have any documents with USA like income tax return records...my suggestion is no need to back file or making things so complicated.  

 

One of the easy option both of you may want to look at is him making "letter addressed to USCIS -US Embassy Manila"  explaining the reason why he didn't have the Income Tax Return Documentation, then ask him to signed an affidavit of support for you, and if his income is not enough, ask his US Citizen relative to sponsor you, and send to you via fedex all the signed copy of Joint Sponsorship Documents, and their copy of Income Tax Return Docs.  Somebody here already did this processing, and yes their visa was approved.  So hope this helps and good luck.

If husband is USC living in philipines but not filing taxes in US meaning he has no US income, then he cannot sponsor.

If he is the petitioner, then he has to sponsor and explain in a letter, how come he was not filing taxes in the US. Since he has no tax returns, you will have to get a joint petitioner who has income IN the US and files taxes there. 

US tax returns/transcripts are a MUST for the I-864 to be accepted.

 

Transcripts are fool proof because in the case of returns, EVERY accompanying document comprising the return is required. W2s, 1099s etc.

 

Also, if sponsor is married filing Jointly, then specific W2s/1099s of the spouse have to accompany even the transcript so that the interviewing officer can be sure that the specific sponsor can indeed be eligible to sponsor .

We didn't submit letter about taxes since we got his brother as his co sponsor. Just be sure you have the complete requirements when they approved the petition.

Excuse me friend, but what about your I-864 and the tax part? you did include your own I-864 alongside that of your co-sponsor, right?

This is for filing for petition. The one that you mentioned for the I-864 is the next step which is for the visa interview.
