How long does it take to get new green card?

My wife's 2-year green card was set to expire on November 19, 2016. We sent in all our evidence in August 2016, and she attended her biometric appointment here locally on October 14, 2016 where they wouldn't let me accompany her during the appointment.

 

My wife says they told her that she would get her new green card in two months after November 19, 2016. So we were expecting something in the mail by the end of January. It's now February 8th, and there is no sign of anything in the mail. Furthermore, my wife can't locate the piece-of-paper temporary permanent residence they sent her in the mail a few months ago.

 

What phone number should I call to get to figure out when we're getting her green card in the mail?

 

Also my wife says they told her during her biometric appt that she would get a green card valid for one year, and then she could either apply for citizenship or a ten year green card after the year.

 

I had never  heard such a thing, and was under the impression that everyone gets sent a ten year green card upon successfully lifting the residency conditions, and that this ten year card has no bearing upon when one can start the citizenship process.

Your wife got some pretty bad information. If you go to Forums --> Removing of conditions (I-751) ----> I-751 August Filers (I am an August filer as well) You will see that so far no one has received their 10 year green card. It appears that they are still processing those that filed in May. They have seemingly slowed down since the new administration took office (could just be coincidence).

 

The paper that you received in the mail is her "one year green card". She will not be getting a new temporary card. That paper simply states that her green card is still valid for another year while they process the I-751 and I suggest she try to locate it.

 

If by August of this year she has still not received her new 10 year card then her window to apply for citizenship has opened and she may apply. This will push the I-751 application as they have to process that first. However you are correct, she does not have to do this. She can wait for the 10 year card and apply for citizenship when she is ready.

Oh no! We couldn't find that one year extension paper anywhere. 

 

Now what? 

 

Call the the local office and setup a infopass session? How much do they charge to stamp her passport? 

 

My my wife is getting ready to look for a new job, so I think she will need to show that her residency is current.

1.) Nothing would happen to her residence, you would just need to make an infopass appointment for them to stamp her passport again before the one year extension expires. Hopefully we will all have our new cards by then! (Fingers crossed)

 

2.) Yes, if the card expires in November: 90 days prior (not always 3 months they are very literal with the 90 days) is when your window opens to apply for ROC, which you have. Same goes for Citizenship.

 

If you go under the forums again --> 4th section down says: US Visa Holder and Permanent Resident Immigration Discussion ---> 6th down is regarding citizenship.

 

I am assuming your wife is eligible to file in August of this year based on that fact that your profile states you filed a cr1/ir1 visa category and you are currently removing conditions (filling our your timeline helps make sure no one gives you bad advice). Once she was been in the states and still married to you for the 3 years then she is eligible. Therefore, yes, this august is when the window would open for her to file.

I would call and make an infopass appointment. I do not know if they charge (I don't think so). Just let them know you lost the paper.

 

Yes in order to get a new job she will need this proof since her green card shows that it is expired, she will need to show that she is not out of status and is still legally allowed to work.

About as hard as them processing within the stated time.

In otherwords, very.

 

New (and cancelled) infopass appointments are dumped into the system between 9pm and 1am (depending where you are in the US) every sunday thru thursday nites, for a monday - friday appointment 2 weeks ahead of the day you are checking.

 

 

A walk-in may work depending on the level of idiot you get manning the desks that day.

So did anyone get their ten year card yet? My wife finally got an infopass appt. When she went they just told her her biometric receipt is good as an extension letter. She eventually found the extension letter though. 

 

One thing they told her at her appt though was that we both would have to attend an interview. Well that was now over a month ago, and we haven't received a notice for any interview. 

I don't think that worker knew what they were talking about. Don't they waive the interview if you provide enough evidence in your original application to remove conditions? We showed lots of good evidence.

Yes. No. Maybe.

Some get approved with no RFE or interview, some get an interview and no RFE, some get an RFE and no interview, and some randomly get called for interview.

My wife and I sent the N-400 packet on Aug 22nd, and soonafter we got an appointment notice at our local office for biometrics for the N-400. She just finished that appointment.

 

Nobody there was able to answer this question:

 

Her one-year greencard extension letter expires in less than two months. What is she supposed to do if she doesn't receive a ten year greencard by then? I doubt she's going to become a citizen in less than two months too.

Nothing - unless she needs proof of status for anything, such as travel or renewing a DL. The card and/or extension letter and/or stamp only serve as proof of status, and are not the status themselves.

 

If so, infopass for an I-551 stamp.

What if traveling north from say Laredo, TX you go through a CBP checkpoint. We did the other day, and some agent thought the extension letter was already expired (based on the letter's issue date) and he thought he was doing us a favor by letting us go.

 

 So you're saying that once the extension letter expires then the CBP will still let us pass after they review their database and see that she's going through a naturalization process?

The agent was wrong, but that is not unusual, as most of them think the issue date is the expiry date.

They have ways of verifying, but in your case it may well be prudent to get the I-551 stamp as proof of status in such situations, to avoid delays caused by it.

 

 

Depending on how quick the N-400 process is, she may never receive a physical 10yr card before becoming a citizen.
