It is not USCIS falt that  you couldn't meet the deadline.<<< You can't sue USCIS for not processing your application in time. If that was a possibility, USCIS would be staying in court 365 days. You took a risk and it didn't pay off.

You should have waited for your I-539 (extension request) to be adjudicated. By leaving before that happened, your application was abandoned and so you were considered to have overstayed, since your period of "tolling" (an authorised period to remain whilst you were waiting for a decision) vanished.

 

You were properly barred.

As regards, as to why would a tourist want to come back, last time around when I had come, i.e. before this stint happened, I could only travel the East coast from the state of New England till Florida. This visit which went south was only intended to roam California, Las Vegas and other states on the west coast and Illinois and Texas which were left out in my last trip. Only after returning back did I learn that I should have applied for some waiver before traveling, but it was already a lost cause.

After this experience I don't wish to travel to the US anymore, its just that I only want the "cancelled" stamped legally removed from my VISA and my name cleared from the wrongdoer list, that's the long and short of it.

Do you know a way by which I can atleast try for a wavier or contest the decision.

 

Deportation remains a part of your history, even with a new pp. Cancellation stamps don't matter if you never want to travel to the US again.

im confused, if he only overstayed a few months i thought anything less then 180 days doesnt incur in a ban? 

 

also, if you overstayed, why would u try to cross??? dont u realize that they know this as it is written on your passport!

The OP wasn't barred for the overstay but instead for the removal/deportation, which is a five year bar.

Filed: Timeline

Arriving on a visitors visa, then adjusting to F 1 then departing

made you have no grounds to be let in, it showed the F1 abandoned

& the B1/1 visa were no longer valid.There is no appeal, you would

waste money on an attorny if you have no basis to do so like a petition

by spouse or famuly You'll be out for 4 yrs

CBP thinks you had immigrant intent, you had overstayed & extended

B4,and would likely do something like that again
