I-131 Rejected....USCIS Reason Seems Inaccurate...Please Help

Hi Everyone, 

 

I'll try to keep this quick and to the point...the subject line should kinda let you know what I'm dealing with, right? 

 

Their Reason: Incomplete Application

- Part 2 Family Name

- Part 2 Address

 

If any of you are familiar with the application, in Part 2: Section 1, my wife selected "1.d." indicating that she is applying for an advanced parole travel document for HERSELF and that she is within the United States. Shortly after that you get to Part 2: Section 2 that basically says "if you checked 1.f. then fill out 2.a. through 2.p." (i paraphrased it)...

 

In fact, if you fill it out the application digitally and select 1.d., section 2 gets grayed out completely because it clearly does not apply to you and does not allow you to type anything in. 

 

I called USCIS customer service and they said to put "N/A" because you're not allowed to leave anything blank. However, I had other parts that were left blank and they never cited those as reasons for rejection. I call again for more clarification and another rep tells me that no USCIS employee is authorized or allowed to give information on how to properly fill out the form; only immigration lawyers or something like that. So now what? I really feel confident that I'm not misunderstanding the instructions here and getting an immigration lawyer is not necessary, but: 

 

1) The information they claim is "missing", by my understanding of the instructions, is meant for someone OUTSIDE of the United States and applying for travel document; which IS NOT the case with my wife. But leaving it blank got me a rejection letter...what now? 

2) I can resubmit again leaving it blank and hope they made a mistake but that just seems redundant and going to waste weeks awaiting for an approval that will likely not happen based on our first attempt...what now?

Yeah you are misinterpreting the instructions.

Theres a difference between saying "if you checked box 1f provide the info about the person" and the phrasing Physical Address (If you checked 1f) Its all about the parenthesis placement.

You are suppose to fill out ALL fields in the form unless its N/A. So you do question 1- You check off one box- which you did correctly. Then you move on to #2. It states IF you checked off 1f use the persons info- not yours for the following question 2... It says nothing about this is only for people for checked off 1f. So everyone fills it out- you would enter YOUR info as the person requesting it UNLESS you checked off 1f- because IF you did then you use their info.Does that make more sense?

I think you did the right thing, OP. You already provided address and everything else in part 1. Part 2 seems to be for those who apply for someone else, outside the US.

Thanks for the feedback. When I looked back I thought to myself...this has to be it, I must have to fill this out. And I thought I agreed with your explanation, but what about parts 2.h. through 2.p.? That part in particular wouldn't make sense with that logic then, or at least that's the part that made me question the logic. Because from that point within the parenthesis it only states "if you checked box 1.f.".

 

Plus, box 1.d. indicates that the application is for ME, and all my information is listed in Part 1 just above. Listing it again here in Part 2, just seemed redundant. So I'm not entirely sure and unfortunately USCIS customer service wasn't much help. I'll probably end up filing it out anyway and sending it back because clearly whether I agree with the logic or not, leaving it blank got me rejected. Thanks for your input!

I agree, but I have no means of confirming because USCIS customer service was useless. I'll likely end up resubmitting and filling this portion out anyway. I am just overthinking it and wonder if they'll come back and say...."well hey, why are you filling this portion out when your wife is WITHIN the US". Just hate the uncertainty and trying to avoid wasting time. My wife is hoping to travel in March and/or May.

 also though, I just remembered I followed your logic at first but remembered why I ended up questioning it and wasn't entirely convinced...

 

When you download the application and fill out out digitally and are typing all the information in, when you've selected the box that i did (1.d.), it grays our the entire section under Part 2 so you can't fill it out anyway even if you wanted to.

It's hard to know with USCIS, they reject applications to left and right for no reason but made up ones. Happened to me too, they accepted my i-485 and i-131 and rejected my i-765 because of not sending the correct fee, wth? If the fee was wrong (which it wasn't) then why would they accept the other two forms? They're just making mistake after mistake, so it's not always the applicant's fault.

No. ..no...and no.... 

The whole point of filling out that portion is that it's the info of another person than the filer that is entered in part 1 (the person for whom the OP would be filing would be overseas..)

 

OP, you have done it correctly, the same way I did mine and according to instructions. You are not crazy!

Like Scandi said, they refused her i-765 just last week due to a mistake... I'm just sorry they let the "intern" look through your applications unsupervised 

Fill it up like it's supposed to be and write a note explaining. Sucks that it's taking time from you and hopefully your wife can get it in time for travel...

Ya know what's funny? They actually listed lack of payment or incorrect payment as a reason as well, when in fact when you file concurrently with I-485 the fee is waived! I just chose not to bore you all with the complaints, lol. The solution there is to resubmit with the I-485 confirmation, btw.

Fill it up like it's supposed to be and write a note explaining. Sucks that it's taking time from you and hopefully your wife can get it in time for travel...

Don't even get me started with my poor experience with USCIS, lol! The customer service automated line asked for my 10-digit receipt number...entered all 10-digits, "not the right amount of digits, goodbye"...

 

Ok, I maybe fat fingered it...called again, input it one-by-one, used a single finger, and went as slow as a 2-year old to make sure..."not the right amount of digits, goodbye"...blood was boiling! Then you finally get to someone by lying to the damn machine and that person is not in the right "tier" to assist you.

Yes I submitted the i-765 with all supporting documents and i-485 NOA1 again today. When they rejected my form they sent it back together with a list of the new fees for every single form, right next to the i-765 it said that fees are waived with a pending i-485 - so I sent the list back to them in the package with that part high lighted. Same thing with the i-765 and i-485 instructions, high lighted the same info on both. I'll be damned if they reject it again! 

 

I think your wife needs to do the same. Resubmit, add the NOA1 for i-485 and everything else you can think of. Hopefully you get another person to look into your forms then, and me too.

Oh did you to include the letters as well? The numbers for MSC?

1. God! this post made me rushed into my i131 form... I filled it out same way the OP did.
2. Left blank all fields in Part 2 after this "If you checked box "1.f." provide...." It's not for me! I stated 1.d.
