Has anyone side loaded a CR1 RFE?

Other person said to you over here that what his cousin's lawyer submitted to USCIS in this situation and one of the things he mentioned about priest thing but your case is different because you were married in the court, so priest is out of question. In India people could get married two ways- first is filing the paperwork with the court to get married but in this case one would need to wait at least 30 days...but the second method is more popular and a short cut which is get married in any mandir/church/gurudwara in a very small ceremony and they will give you a certificate and then you go to court and get registered your marriage and court will give you a marriage certificate. That's it. So this seems to be the case in this person's cousin wherein cousin got married thru a priest first and then marriage got registered in the court in order to obtain a marriage certificate. But in your case priest is out of question if you were married in a court. Further, you can not marry again now for religious wedding, rather you can renew your bows which is perfectly ok...In that case, priest can get married. So you should start planning on that if you want to get succeed in your interview; otherwise you could have a rough road ahead...As I said, I'm right now going on thru this road....

What I meant was that we did not have a sagai, mehendi, wedding/reception etc., (which is what I seem to regard as a traditional wedding) where we had attendees.  We went to a Arya Samaj Mandir and got married then we went to the courthouse and had our finger prints taken and signed stuff and registered our marriage. I just spoke to my husband and he told me that we need to send in the document we got from the Pandit from the Arya Samaj. I think I should have included this in the CR1 package :blink:

 

I will be sending in the needed stuff for our RFE next week and see what happens. Thank you again.

As I said earlier in my posting that there is only two ways to get married in India, in religious wedding or a civil marriage. And your is also one of them. However, you didn't marry in the court, instead you married in Mandir/temple. You just registered your marriage in the court to obtain marriage certificate. I don't know if you should have sent Arya Samaj mandir's marriage certificate from the Pandit or not because there is no way to know what they could ask for. It's all depend on the assigned adjudication officer. I married exactly the same way and I also married in UP in Ghaziabad...and submitted only a marriage certificate to USCIS and didn't have any problem. In my case, there was no sangeet, mehendi, wedding/reception, nobody neither from me nor from her...and not even honeymoon...Don't know who is beneficiary here in your case. All I'm saying is that you should try to have a colorful religious/traditional wedding; otherwise you guys might have a very hard road ahead at the time when you would have interview in Embassy in India. All they care about colorful Indian wedding, trust me. And don't leave everything on your husband to decide, instead work together with him...mutually.

Its just a guessing game as nobody knows for sure what USCIS is looking for when they say about Memorandum of marriage, so I wish you a good luck with your RFE. If this is not what they are looking for then they will not give you another chance, instead would deny the petition. You can  always re-apply but new fees and waiting in the queue again...Very good luck to you...Hopefully it turns out in your favor...

I married February, 2015. My wife (beneficiary) had her interview in Delhi a few days ago on December 22, 2016 and her case has been put on hold but consular has refused to issue her visa....

Its not straight up...they have already given you a chance to present/submit what they want thru RFE....So if you fail to submit then they will not give you another chance because they have already given you a chance to submit whats required by them.

Did they give a reason for putting your application into administrative processing? What were the other red flags in your case that you mentioned, if you don't mind me asking?

 My wife and I have had many red-flags which you and others might not have, but consular officer and fraud-investigators in US Embassy in Delhi, India were more focused on us not having colorful traditional wedding and not mingling between relatives during wedding. There are huge red flag in our case...but in my opinions none of those raise to the level of denying a case given what I know about immigration laws and cases for the last 26 years in this country. One thing I would say to you is that stay away answering to negative comments by negative people on this site. They will make you an evil and call you a troll just because you came here and truthfully described your situation and looking for help...and many of those people are either long time members or moderators. More negative vibes here than positive ones. I have been watching all this drama here for many years. Rather than help, most people will focus on making you an evil. Just stay away answering to them...
