Hey guys!

I am in a similar situation to all of you. PD Aug 2016, my husband is on an F-1 visa and we have the I-130 approved. Has any of you claimed your spouses as dependent on your tax returns? How does that work? He doesn't have a SSN so that makes it a little difficult. Does anybody know?  Thanks!

I and my spouse both have SSN and we filed married jointly. I think it's possible to claim your spouse as dependent. I would consider filing thru HR block or other entities that can advise you better.

You can't/don't claim your spouse as a dependent but you do get a bit of a tax credit if they are unemployed.  The amount depends on your tax bracket.

I am in the same boat. We have filed jointly for the past 2 years. I have an SSN as I worked on campus as an F1. After graduation I received my EAD and found another job. I also volunteered for VITA and received tax filing training from the college. You must attach a statement that your spouse is filing as a resident for tax purposes. Check IRS page at https://www.irs.gov/individuals/international-taxpayers/nonresident-spouse-treated-as-a-resident or consult a tax professional.

I did, I believe everyone receives this. I let the NVC know that I'm proceeding with adjustment of status through USCIS and they said thank you and please ignore the directions we sent as these were for visa processing.

Some people say it's even ok if you completely ignore the letter.

Thanks,

I believe we should be getting that in the mail soon. After you got the letter, did you get another one from the USCIS when your PD was approaching? Or did you just file your AOS when the PD became current?

I filed for AOS when my PD was current in the "dates for filing" table (you have to make sure that you are allowed to use this table though, because it's not the same each month). My PD became current for "final action" this month and still expecting the interview letter.

I don't think this can be correct because this is what the "dates for filing" table is about. I believe your application will be returned if you send it earlier.

You have to look at the "dates for filing chart" to determine when you can submit your AOS application.

Chejemmie, any update with your interview? Did they reschedule it?

I went to the cancelled one. Got in but they didn't do the interview. No new date yet. I'm exhausted. Got my new EAD and still waiting for SSA to update my name so I can renew my DL.
