Forms / Which last name?

We have the interview soon and i was double checking some forms.

I did send her the forms in her -Married- last name which is her official name now to the NVC. (She took mine)

 

But the case name is her maiden name,because that is the name still on her passport. They said the case name should match the passport name.

Which way should i fill the AOS forms and what not? With her name or maiden name? Does it matter?

 

Should i put like Smith/Doe and just list both?

Leave it as they are?

If she wants her married name on her Green Card, then she will need to get a new passport before the interview; otherwise, the visa will be issued in the name that matches the passport and the Greed Card will be issued in the name that matches the visa.

 

The answer to your question depends on whether or not she obtains an updated passport.

I did tell her that,i dont think she can update her passport fast enough at this point. She will just have to use the green card for two years or so before anything changes.

 

Let's assume she is going to use the passport with her maiden name. How should i fill the forms?

If she gets an updated passport in time,we dont need to change the case name or anything right? They would just do that at the embassy or something?

If she has an updated passport, she will need to bring it to the CO's attention.

Yeah she was going to call the embassy/consult tomorrow to see if it's alright if she updates it. Otherwise we are just going to have too go with the maiden name.

I don't know how it is there, but usually if you change your name in your US passport you also get a new passport number. So obviously if that kind of vital info has changed you'll need to inform them of the changes.

 

The best bet is to call the Embassy/talk to someone official about it and see what they require.

On some forms it says family name and maiden name. I should leave family name as mine right? Only use her maiden name on forms that just ask for last name only?

I've had three different last names. (Birth name, changed my name, and married name). It was kind of confusing but so far I haven't had any issues with how I did the paperwork.

 

Maiden name: definitely put whatever the name was before you married (most likely it's what's on her birth certificate). Family name I just interpreted as "last name" so I used my name after marriage for that.

 

I would only list her maiden name if it specifically says "Maiden name"....in all other cases, user her current last name (I'm assuming it's the same as yours.)

Yeah problem lies her passport name is her maiden name but she took my last name so her government see's her with my last name.

So the case is suppose to match what your passport says. Her passport is not updated and still says her maiden name.

Ahhh, got it. If you want her green card to have the new last name, she definitely needs to change her passport first. Otherwise you'll have to use the old name on her passport throughout the whole process. So, yes, the name on the passport determines everything.

I dont mind what her name says on the Green card.. You can change it in the next phase when you renew your GC for 10 years anyway.

I just want the forms filled out properly.

So on the paperwork that asks for maiden name and family name,ya think i should put her maiden name for both?
