Ok, but we can't change the last two. So you think they scheduled the interview because of that, thats fine. But it means that want to deny us based on our answers? (Nothing related to my overstay or his marriage was asked)

They were already suspicious and then you added to it with the mistakes when answering the questions. Previous marriage and petition are two of the biggest red flags going for any application, regardless of how genuine the current relationship is. Once the notice arrives let us all know what it says and I am sure we will be able to help. For now, focus on gathering all the evidence of your relationship:

• Written affidavits (friends, parents, co-workers, anyone who will put a pen to paper to say you two are the real thing)
• Credit reports (his and hers)
• Proof of cohabitation (do you rent or own?)
• Proof of joint finances
• Proof of joint insurance
• Receipts for any joint assets
• Wedding evidence (including receipts for photographer etc.)
• Any joint travel? Get tickets together and photos
• Photo album
• .....

There is no need to blame her for her mistakes!!!

But Banana_Princess, keep in mind that officers are trained to look at your case in a curious way at all times.

You need to be proofing and convincing them that your marriage is real. I however have to admit that there was confusion and mistakes that gave them a red flag (for me it looks like that you got the wrong officer).

All you need to do now is to wait for the letter and fight back with your lawyer, they can't completely deny or deport you that easily.

I am personally horrified by hearing this story, and I wish it would never happen to anyone who leads a true marriage.

Keep collecting evidence of your martial life and stay in a positive attitude and don't get upset over the officers (learn to overcome anger with happiness). -Because its them who decide about your future.

If it was as simple as having all the paperwork to be approved, then interviews wouldn't happen. So there is personal discretion that can be used, because it is possible to back up those feelings with proof. They can say that they don't feel your relationship is bonafide because of X,Y, and Z, and have X, Y, and Z be things on paper that they can say "Look, here's why I feel this way".

The wrong answers probably won't be the reason on the NOID, but the answers could have been the final straw. Say they have some form of proof that they can use to say your relationship isn't legit, and they just wanted to back that up with bad answers by giving you a small stokes interview. Now they have proof A backed up with Proof B, your own words.


But yeah, you're just going to have to wait for the NOID and see what they want from you, speculation isn't going to get anywhere, much like the common thread of "Why did I get an RFE, no I don't have it yet, I want ya'll to tell me!"

Thank you very much for your support! I think we were one of those people who i occasionally read about "If our marriage is real we have nothing to worry about" and than BAM! Surprise: uscis doesn't believe you.

I'm doing my best. The lawyer said they may visit the apartment, i hope they will. I just keep telling myself that everything is for the best, we have so many plans after i get my gc (travel, my school), may be it's not the right time for that yet.

Ok thanks to you i just thought of something, this is out situation: we have 2 savings together and 1 checking. We mostly use checking to pay our credit cards and rent. We have separate credit cards because those are travel CC (american airlines, SPG, hilton), we get miles and hotel points on everything, and if we got them together we wouldn't get that many points (sign up bonuses are pretty big). Plus, i have shopping credit cards, such as Victorias secret, express, macys, and i have two more that i got before we got married. He only has the travel ones. So we do not have credit cards together or any big loans. Do you think it could be a problem that or credit cards are separate? Again, we were not asked anything about it even though they have all our statements and can see all that.

We submitted bank statements from all 3 accounts, tax returns (will be 3 years of tax returns by the time we reply to NOID), lease (for all the years we lived together), boarding passes (we have a lot of those, thanks to the cc lol), pictures from traveling and with the family... also different cards from friends and family addressed to the both of us, those jewelry receipts...

Phone bill: me, him and his mom are on the same bill, all 3 numbers are shown but only my husband's name.

Electric bill: Under my name, but we always use his cc to pay. I moved in by myself first and he moved in 6 months later and we never thought of adding his name on the bill (yeah! Well we were not building our life around immigration, i guess we should have), but we saved his cc in the account and just pay with it all the time.

We did not submit affidavits yet. I had them with me at the interview but the lawyer said not to give it to the officer unless asked.

And we do not have health insurance because I'm not eligible for it, and i believe we still have a proof of it... we received a letter saying that I'm not eligible, may be we should submit that, thanks for the idea!

My husband went to the ER recently, he put me as an emergency contact if they asked (i don't remember if they did even thought i was there - my memory), but he would have put me. So we can get that paper too.

Not one of your names and one of you pays it with your card. Shoot, I pay a phone bill that's in my dad's name, and was paying a cable bill in my ex's name for a while, anyone can pay anyone elses bill if they want.



So what do you have with BOTH your names on it? You've been married for 3 years, ideally you should have bills in BOTH your names, rent in BOTH your names, insurance car, life, renters in BOTH your names.

If you only have things in one of your names, other than a joint account, that right there could be the nail in the coffin.

Should we add him to the electric bill now? Thats the only bill we pay. But isn't it too late and they can say "oh they just add him now not 3 years before..."

In both our names: lease, 3 bank accounts.

We do not have a car/life insurance

And they don't need mine or his moms name for the phone bill, they only need one person.... there is nothing we can do about it really... Same address is shown on the cell phone bill and electric bill.

not sure if this will help you, but me and my wife also had stoke interview when i applied to remove condition on my green card. it was also in chicago.

We answered pretty much all the same but few things (how many times ive traveled out of the country, i said 2x she said once. and we couldnt remember each other phone #s. maybe one more not sure)

it took them 9 months to respond and send me new green card.

I get the vibe from your response to my post that you respond in some kind of denial mode. If you don't see the problem about something it doesn't mean there is no problem. USCIS and you can see the same situation at a very different angle. Anyway, even if you think my opinion is invalid and all these raised yellow/red flags I found are nothing, anyway all you can do is to wait for the denial notice and see what is stated there. But my opinion is that you have some clear red/yellow flags I stated above and that may be the reason you're denied AOS, even if you disagree with it.

No, Victor, i actually asked you a question without being sarcastic or anything. I just don't see how this [that we got together before his divorce was finalized] can make them think that our marriage is fake and was hoping you'll explain your point of view, and i still do, if you don't mind. May be they way i write "sound" mean to you? I don't mean anything like that, i promise. I do not think your opinion is invalid and do not disagree, i asked you all for your opinions to consider them.
