Thank you guys so much.

So my fiancée has her SS-5 application form ready.

We will be bring her foreign passport with proof of K-1 Visa

Also printout of I-94

And I saw the SS-5 form application instruction...We do not need the birth certificate because they do not accept birth certificate for U.S immigrants.

The birth certificates are only for the US citizens

You are mistaken.

From your own link that you posted:

"You must present your foreign birth certificate if you have it or can get it within 10 days. If not, we will consider other documents such as your passport or a document issued by DHS as evidence of your age."

I was asked for my birth certificate, so were a great many people who have posted here about their experiences obtaining their first Social Security Card and number.

I have just applied and they did not ask for birth certificate. Other items were asked for. And if you don't have I-94, they will verify your status with IMMIG office (which will make your wait for the card/number longer, so it is better to present your I-94). So, you don't need birth certificate. Best way to prove that to yourself is that you make a trip to their office and apply. If it turns out you didn't need it, then it will go through. If you need it, the worst thing they will do is to ask you to go get it. I think the first outcome will be the case. Good luck!

They always verify you with immigrations and i-94 is always needed. You can go into different levels of verification depending on if the level 1 verification (electronic against SAVE) goes through right away or not ( as said this is required). The longest wait is if you have to go to level 3 verification in which case they send your documents by mail. I just got through this process and I applied October 28th. It has nothing to do with if you present your i-94 or not. It seems some offices ask for the bc and some do not. OP, just call your local office and ask if you want to save the trip and the potential extra work of certification if it isn't needed for you. :)

Read the bolded part.

Also a certified birth certificate is a birth certificate issued by the original issuer. There is no other way to get a certified birth certificate. They wouldn't keep the document anyhow, they just look at it. Don't send the birth certificate anywhere, just bring it with you and likely they'll just use her passport and visa as age verification.

I took my birth certificate but wasn't asked for it.

1) I would suggest starting a new topic so ppl can read this, it's not very visible here in this thread.

2) WOW, I was not aware of SSO conducting immigration interview... lol They only need to verify your current status against the SAVE db which is what is on your i-94. Basically their job is just to verify that your eligible by immigration status and SS policy...

3) No I was not asked anything like that at all... and me and my now hubby both sat down with the lady and had a conversation really...

4) My best guess would have been that they want to check if you have had a SSN before maybe... but the way you described it seems like a weird way to go about asking!

edit: I'll ask if mods can split your post to a new topic.

That's exactly what I thought it was gonna be! Just a casual talk about my current status and a few simple questions (although the question whether I ever lived  and visited the US before is of course also very simple, just didn't expect that question and that it can cause problems if I forgot visits).

When me and my fiancé sat down she made us swap seats and then told my fiancé that he is not allowed to help me with the answers nor is he allowed to answer them for me.

She also asked whether I ever filed for I-797 and named a few other forms so I asked what these forms are. She said their names and so I said no I never filed for them. Then she went on and said whether I ever filled out an I-94. I was confused because she had my printed out I-94 right in front of her on the desk so I figured she meant another form and I just heard her wrong and said No I have not. Thats when she started this whole thing about that I shouldn't be lying at an official interview like this and if any discrepancies ever occurs between what I am saying today and another time, it can have serious consequences.

Since you didn't get the question about previous visits I'm guessing it is not that important that I didn't answer it fully... that supports my assumption I had that it's not that important. I was wondering what that had to do with applying for a SSN anyways if I said no to the question that I have never worked in the US nor did I apply for a SSN before.

Oh and thanks for trying to put it as it's own topic. :)

Timeline

My fiance came on the 22nd, his information wasn't able to be verified by anybody at the SSA until today. This was despite the fact that his I-94 was available online within an hour of him crossing the border. We had been told 10 business days is the standard time it takes for the SSA office to be able to see the records in their verification system, so that still seems to be accurate for certain points of entry.
