I hope someone here who is self-employedwho knows if there are other ways to prove such a recent self-employed income in a way they will accept..

I am self employed. Yes, there are ways of proving income, but proving an amount that is below the requirements won't help this case.

They do NOT meet 125% or even 100% for the purposes of the aff of support. Not for the 134 and not for the 864.

I really dont understand all the discussion on this thread. The fiance is self-employed. He has only been working since May. Even if he was earning 5x more each month- they probably wouldnt accept it because when you are self employed you need to present at least ONE tax return with a schedule C to show you have a steady income. He has yet to file taxes and when he does, it wont even be for a full year of self employment.

But if he submits his 2016 taxes (asap in Jan) and continues to earn at a steady pace- he may get approved for the aff of support (864) if they marry now and file the CR packet because by the time he needs to submit it- he will have passed the 1 yr mark as self employed, have a tax return, and have additional months towards showing stability. They would also get the chance to use a co-sponsor if needed.

As of right now- they are being asked for assets. It is either part of the Embassy policies to be requiring 5x (just as they dont allow co-sponsors or self sponsoring) or the Officers decision. There is nothing that can be done about that. So unless the couple can come up with that amount of assets required and even if they do-- they have to prove to the Officer where it came from (!) Well, it seems the K path is closed. It is rather unfortunate that he returned to the US and decided to become self employed through Uber. If he had obtained a company job for the same pay rate- he may have had a shot at getting approved since you do not absolutely need the 1 year tax return. They wouldve looked at his overall time at the job and opportunity for advancement though. Its a tough embassy- so who knows how it wouldve balanced out- but a company job wouldve at least had a shot.

I suppose they could go for the K again, but I just dont think its wise. Im also not sure if theyd be able to hold the visa as it is- or if it would make any difference if he does file his taxes asap because once it was evaluated and determined assets were needed- a significant amount of time would need to pass or change in circumstances for them to re-evaluate their decision and decide the income is stable and acceptable.

We have a co sponsor for spousal visa, that's not an issue.

But do you think we shall move case to Paris? as we initially thought they going to send my case there and not in country of my residence. Also in french US Embassy they presume that french citizen will likely not became a public charge and they not asking for affidavit of support. It is never listed in packet 3 and they don't have packet 4. Or you think that is a waste of time?

You can't shop around for embassy that you think will have different requirements. You have to interview at the embassy that has jurisdiction over the place you are resident in - Sweden in your case.

french US Embassy said me in person, when I visited for inquiries, that I can chose, since i'm citizen, regardless of residence. But maybe now it's too late, I will ask on Monday.

Today I had my appointment with French embassy and they were very considerate about financial situation.

 

I answered questions about my education, languages I speak, my expat work experience, passive income from my property I'm renting, family house where we will be living in US and they didn't ask me any additional proof that I won't be a public charge. So no more $100K+ cash ridiculous requirement 

 

My case is complex because I lived in many countries and still under AP but I hope I will get my visa in a few weeks. They told me if AP is ok, they will send me my passport with visa. Fingers crossed.
