Hello there

We submitted our complete AOS package including I-485, I-131, I-765 along with all required supporting documents around mid November. The check was never cached and we were wondering what is going on till we received the returned package today from the USCIS along with a I-797C notice indicating that the payment amount is incorrect or has not being provided.

We had included a personal check drawn on a US bank for the amount of 1070 $ to be paid for US Department of Homeland Security. The personal check had the name of the US spouse (myself) and my old address printed on the top left corner, I had my wife name (the applicant) hand written at the bottom of the check. Is it possible that USCIS rejected the check because it was not having the applicant name and address printed on the check? I am wondering what should I do different when I resubmit the package. Should I use the same forms dated and signed a month ago or should I print new forms and documents taking into account that all documents on the returned package has a computer stamp on the bottom of every page.

We are confused and I appreciate your comments.

No, it doesn't matter if the immigrant's name was not on the check. Anyone can pay. It seems there was a mistake, on your part or theirs.

What category did you put for the I-765? (c )(9 ) is correct and what it needed to be.

If everything was correct, then send back the same forms, add a note on top with your payment that you are filing the I-131 and I-765 with the I-485, and therefore the fees for those 2 forms are waived. $1070 is still the correct amount for now ,so hurry and mail it back before the fee goes up.

I used category (a) (6), it is quite confusing and here is what the instructions says:

"K-1 Nonimmigrant Fiance(e) of U.S. Citizen or K-2 Dependent--(a)(6). File Form I-765 if you are filing within 90 days from the date of entry. This EAD cannot be renewed. Any EAD application other than for a replacement must be based on your pending application for adjustment under ©(9)."

Even if I used the wrong category on I-765, do you think this is a good enough reason to return the whole package including the I-485 and pointing to a wrong payment?

Hi all,

I wrote (A) (6) too :( and my package delivered last Tuesday (december 6th) and I have not heard anything back yet. They haven't cashed the check also. I feel like they are going to send my package back for the same reason :(

The toughest part for us was waiting and wondering why the check was not cashed for more than three weeks.

Ah shoot! I'm still within the 90 days from POE but we put ©(9) because we filed it with the I-485! You guys think it's gonna get rejected? We included a check for $1070.

03-19-2021: Officially an American Citizen 🇺🇸 Entire journey from initial K-1 Visa filing to Naturalization took 5 years, 8 days.

I am in a rush because fees are changing after December 23rd and it is a crazy change! :(

my husbands expires 12/23/16 and I applied on 11/21/16 for NOA1 12/05/16 notice on 12/08/16.... :thumbs:
