8 months now,I-485 still pending...what shall I do?

Hi, guys, so happy to hear good news about your green cards being processed smoothly, and congratulations to those who already got green cards.


My case seems to be a little more slowly than other and I have been waiting for 8 months since I filed the AOS.


I entered the US by K1 visa in January and got married in 27th, February.


I filed my I-485 in March 16th, 2016 and fingerprint fee was received on March 31, 2016.


Luckily, I got my work permit and advance parole in May, 17 so I can travel to my home country.


As time goes by, I become more and more nervous and impatient about my green card process.


Anybody like in my situation ever try to get help from local congressman or senate to remind the USCIS of your case?


Does that help? If so, how should I do it? Just send the local politician an email or it should go through some kind of link on the USCIS website?

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Thanks, however we will wait until after our 2 year marriage to contact anyone in hopes of the 10 year GC being issued

and to bypass ROC. ;)

You can file a mandamus action in federal district court seeking to compel USCIS to adjudicate your I-485.

That's very much a last resort move, however, and you should obtain highly competent legal counsel before doing so.

You are in security checks, if you file a writ of mandamus to force a decision,

understand that it could end up in a denial because the checks are

not complete. They are so backlogged with checks and there is really nothing you can do to speed it up.

I suggest you wait it out rather than face denial, re filing and going through the same checks again.

Pakistan nationals have long checks.

I had no idea you were going through that!...

I know it sounds messed up but with all that you guys have been through I really do hope they sit a bit on longer and give you the 10 year card so you dont have to ROC. You deserve some kind of a break!!

I know it sounds messed up but with all that you guys have been through I really do hope they sit a bit on longer and give you the 10 year card so you dont have to ROC. You deserve some kind of a break!!

Thank you Damara. We both heard the IO mumble something about a 10 year GC but not sure what and we think she may

let us marinade in the stack of applications until we qualify for the 10 year GC, could be wrong but we both thought so.

As long as we are together and after all the mess we been through we are pretty chilled about it.

Come January I will be on it like flies on rice :)

I'm the same. 202 days from filing and counting. i haven't scheduled an infopass appointment yet but tomorrow i'll be meeting with an immigration lawyer hoping to bump my case. This is frustrating. :cry:
