Hello! I really need help with this case. I came to the United States with a k1 visa. Im adjusting my status and yesterday I received two letters from USCIS telling me that they were unable to complete the processing of my Advance parole and Employment Authorization card.


Im gonna write what they are asking for exactly how it appears in the letter:



Please submit a copy of a Federal Government-issued identity document, such as a passport showing your picture, name and date of birth; a birth certificate with photo ID; a visa issued by a foreign consulate; or a national ID document with photo and/or fingerprint. A previously issued Employment Authorization Card (EAD) is not acceptable evidence. If you have recently married, please also submit a copy of your marriage certificate with your married name.



Please provide proof of name change.



What I don't understand is if all that Identification documents they are talking about must be from here or from my home country. I already sent them copies of my passport, visa, I-94, Birth certificate, marriage certificate but of course that I have my maiden name in all of these documents so I don't have idea of how can a provide them with proof of my name change, isn't the marriage certificate enough to prove that? I got my social security too, with my married name but it doesn't have a photo on it. I already talked with the courthouse where we got married and they told me that my marriage certificate should be enough but I don't want to send it and then receive another RFE for the same reason. Please somebody help me

I would call the customer service line, ask for tier 2 and then review with them. I wouldn't write. It will just take more time and it won't help.

As far as whether copies should be from U.S. or Colombia on the copies send everything you can get your hands on. If it's each Spanish, like my spouses was from Colombia on the birth certificate and other passport and vaccinations, everything has to have a certified translation. The could have lost stuff before their review. It happened to us. Assume they have nothing each time you send anything. As far as married name changes. There should be many here that can help further but if not let me know and I will dig. Also, they could have just had what was needed and made a processing error. We have a list of errors made by them but just got verbal approval on AOS.

04/20/16: Case updated to Case is ready to be scheduled for interview as of 03-17-16

05/11/16: Bio. Appt.

06/06/16: RFIE Mail / I-864 1040 tax form (missing) resent overnight shipping. Second submission of 1040 form for 2015

08/09/16: Status update to interview scheduled for September 13th

08/17/16: Status updated to interview cancelled

08/18/16: Status updated to interview scheduled for September 20th with corrected receipt number. AKA "D" day

12/01/16: Interview: Verbal Approval

12/06/16: Status update to card has been mailed

EAD

03/29/16: Date Filed :

Case rejected for invalid fee and/or signature (failed to sign both areas - Doh!)

04/18/16: Date refiled

04/19/16: NOA -Case Received

07/20/16: Case updated to card being produced

07/26/16: Card received priority 3 day mail

There are many variables that can cause this. Usually the letter gives you a clue... Your letter makes no mention of needing translation but it could be the issue, another issue is sometimes needing the docs to be certified but again it usually makes a reference to that. They couldve lost or misplaced a document. In that case you wont know, so youd want to resend a copy of everything.

Often what is an issue with hispanic/latino names is how they typically have multiple last names- you know what Im talking about? Depending on how it was entered on the K visa you are in the USCIS system a certain way. It may not be the way you want or think. SS maybe interpreted it a different way or took it as you told them. The marriage certificate may be written in a totally different way. If you go to the DMV you can end up with trouble there too.

Do you have multiple last names? It can help if you list it out here. Do not use your actual names- just fake names in place like Sally Jones Smith now Sally Jones White or Sally Smith White or just Sally White or whatever. Just how it is on each doc that differs and maybe we can help you make sense of why they say it doesnt match. Because typically when they use that blunt show proof of name change sentence like you posted at the end they are saying your docs dont establish you have a right to use that name.
