Hello all,

Please I need help.

This is all new to me

I am an US citizen living abroad with my spouse.

I tried filing thru the closet USCIS near me, but they informed me that they could not take my case. They said only those living in Russia can file thru the USCIS there.

I have been living abroad with my spouse for 3 years. I recently traveled home to file and try to get life started so we can try get thru this process.

But after a month living apart was too much for me. With depression and anxiety attacks, I moved back abroad with my spouse, as we await this process.

My question is:

Will it be harder or take longer since I am here with him?

I am not working while abroad(and haven't worked for the 3 years Ive been with him)

He works and supports me

What is the next step after filing the I-130?

My case was just transferred to another USCIS on Oct 20, 2016

What other documents should I prepare for the next step?

Please help someone

I hear so many stories concerning this filing process and it seems as every case is treated differently

Well, for the start. Since you're US citizen you have to establish domicile in the USA. I assume you fill your taxes, since its your responsibility no matter where you live. And you are the one sponsoring your spouse. Which means, you need to show income and/or find another sponsor.

So before he gets an interview I need to provide domicile in the US?

And my question is

Since he is the one working can we provide a bank statement showing we have funds to live until we find work?

I heard some stories in the past of both living abroad and visas being issued.

I am not sure how that happened.

So without 3 years of past taxes and housing in the US, I am screwed huh

Either you need to reestablish domicile, or have concrete evidence to demonstrate intent to reestablish domicile

unlikely unless you have substantial liquid assets in USD, more likely you will need a cosponsor for your affidavit of support

Either you need to file back taxes, you will very unlikely owe anything, or if you are not working, then you will need to provide an explanation why you were not required to file taxes (no income), note even though you do not have any income you will still be the primary sponsor for your husband

You will need to mail your package to the lockbox, processing will take place within the US with the exception of the interview and final approval within his country

It will not take longer, but could be harder as you need to reestablish domicile (please do a search on this page to see how to establish domicile) and you will very likely need to find a co sponsor (basically someone willing to provide financial documentation and sign a form that they will be financially responsible for your spouse)

What is the next step after filing the I-130?

Please read the guides on this page, note the I130 needs to be sent along with other forms and supporting evidence, it is not a stand alone form that you send

Ypu will need 3 times the amount needed to qualify in the bank. Your husband can't self-portrait sorry since his job will end when he leaves Russia.
