No where in the 129-F does it ask for your "engagement" date or anything like that, so if that's provided then you'll do it on your own accord.

CO's want marriage to be treated seriously, someone being engaged while still married shows they don't treat marriage very seriously. Even if he explains that he didn't get a divorce... just because no one did paperwork... it most likely will show that marriage is taken even LESS seriously because no one cared to even get a divorce.

I'd say, unless the CO asks, I wouldn't talk too much about the transition from first marriage to new fiance.

How would you know if a CO thinks whether or not someone take marriage seriously in this case? I didn't take marriage any less seriously to my second husband than I did to my first. In fact I took my marriage more seriously to my second husband because I knew what was at stake.

Regardless of what the CO might think or not think, just be honest about it. Lying about dates or trying to hide the fact you got engaged before your divorce was final (if asked directly), can only lead to trouble. Better to have a CO think poorly about your decision than get slapped with a misrep.

He was in his early 20's when he married for the first time, he married because his ex got pregnant and due to a name change he was showing up as "legally single" for years which is partially why he didn't do the paperwork. Also, in his country it takes 3 years to finish a divorce, so there was that whole time.
