Two respones to the same RFE within two weeks of each other

I, I-130 petitioner, was married in the past. I became GC last year (after the divorce and before my new marriage). I'm petitioning for my wife and I'd sent out the I-130 application with all the documents back in May.

I received an RFE on 09/08, mailed out my response on 09/09 which was received by USCIS on 09/13; The RFE was for "Proof of Legal Termination of Marriage".

A couple of days after I mailed out my response to the RFE, I realized that it may not be sufficient so I contacted my lawyer overseas to work on getting more evidence, which he did.

I used the same RFE letter (with bar code and all; luckily, I keep a copy of all documents) and mailed out the new set of documents last Tuesday, 09/25 and according to USPS, they were delivered on 09/27.

Current USCIS Case Status is still Response to RFE received on 09/13 (That was my first response).

My question:
Has anyone been able to successfully send two responses to the same RFE? As in, Did IO take the 2nd response into account?

Will the "online case status" get updated when USCIS receives/scans my 2nd response?

hi

did you keep copies? nobody knows if they will successfully get the second paperwork to you file, so if you have copies, you can send them at the nvc stage, but always keep copies for yourself

I would say yes, the 2nd response will be matched with your file and given to the AO for review, and if the 2nd response was received before dead line of the original RFE, i say it will be fine and accepted.

Sent: 9/12/16: I-130 + I-485 + I-765 (USPS)

Delivered: Sept. 15th 2016 to Chicago Lock Box

Interview Feb  21st, 2018 for I-485

Interview  May 13th, 2019 for I-130 Stokes interview ( 2 minutes)

NOID issued May 17th 2019

June 5th,2019   USCIS received my response on the  NOID// Addressed the NOID myself, No lawyer ever used in case.

July 1st, 2019  10 YEAR GREEN CARD APPROVED

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

July 11th 2019   Green Card in Hand

Yes, I do have copies of everything.

The thing is, if they don't get my second response they're highly likely to deny my I-130 petition in which case, there won't be a NVC stage and I'll have to start all over again.

Did you include copy of the RFE sheet when you sent the 2nd paper? Also did you write your case number on papers you sent the 2nd time. I still feel if they receive it before the RFE deadline, they will accept it, either way , it will go into your case file. I wish you luck my friend, keep in touch...
