Hi friends,

Have a quick question on I-751 Part 5.

Im assuming this is pertaining to just children your filing ROC? Or is it also USC children you had after marriage?

It says "List ALL your children" so do just that, list them. If they were born in the US then mark "NO" to "Applying with you?".

I had the same question when I filed recently and was advised that it's ALL children whether filing with you or not and whether from your current marriage or a previous one (for instance, I included my son who is in his late 20s and still lives in the UK with no intent to immigrate to the US either now or in the future).

I have one more question about Part 5. I was told by others to list "ALL" children

So does all mean "step children too", should the USC spouce list children from his previous marriage?

Or, Just list the children pertaining to the Conditional Resident spouce?

I'm 99% sure that this really refers to the biological children of the conditional permanent resident. (However, what harm would it do to put all the kids that live with the couple? Yes, more typing... but other than that...)

I added my husband's kids from his previous marriage too. They're all USCs of course so I just marked up that they're not applying with me. I figured it's safer to add more information than they need than chance leaving out something that should have been included.
