According to your post, OP is criminal in both Pakistan (under local law) and in USA (for false representation).

USA doesn't care for your laws. I believe, OP's current GC should be scrutinized for false representation.

Agreed. We've all busted our chops to make sure that our documents/relationships/kids/criminal records (etc) are cleared up and represented as they are, to the truest of our knowledge to NVC and the consulate.

To have someone KNOWINGLY lie on multiple documents and during their interview - under oath!? It really upsets me.

Especially considering I've seen several people go through so many RFE/221s simply because they forgot a paper or submitted 1044s instead of W2s, or proof of domicle wasn't documented enough.

Misrepresentation is usually only a big deal if it's "material" meaning you lie about/conceal something that if the CO knew the truth about, they'd deny your visa.

In this case knowing about OP's children would not have caused the immigrant visa to be denied.

That said, obviously he should have listed his children and when he petitions for them, the situation will be heavily scrutinized, but it's not the end of the world nor is he unlikely to be able to eventually bring his family over.

Accordingly to BBC documentary, the children are murdered secretly. So technically, no one is unmarried with children.

I am assuming they were living together and with their children and although not married, they represented themselves as such, to avoid repercussions? Totally guessing here.

Misrepresentation is always a big deal. Hence, the call for additional scrutiny or vetting of immigrant applications.

So you saying it is okay to lie if is not material or if CO cannot find out? Like, if nobody sees it, does it happen!!

Which is presumably what a field investigation will find, that they were married.

Depends what "big deal" means.

It's certainly not OK, but in this case it is unlikely to have any consequences. Some posters are saying he might lose his GC over this. That is inaccurate, unless of course he was in fact, married, in which case he was not eligible for the visa.

The issue is was he actually F3 but lied to get his GC quicker, not exactly the first time that has happened.

I realize that. If he lied about being unmarried, that's a different kettle of fish and he is in a world of trouble.

In that case not only would he lose his GC, but could also get permanently banned from the US.

Which is presumably what a field investigation will find, that they were married.

Yeah, in that case, he's definitely in trouble.

There are too many posters on here giving legal advice based on their opinions vs reality.

There is nothing criminal about this. Immigration is a civil matter. The OP is not a criminal under US law for a misrepresentation. You are just making stuff up.

Learn the difference between a material misrepresentation vs a non-material misrepresentation. You don't seem to know or care about knowing the difference.

The difference that matters is F2b to F3.

Totally true, but we can only work with the story OP tells us. He stated he was unmarried with out-of-wedlock children.

Certainly if that's a lie and he was in fact, married, that'll cause major problems down the line, but that's all hypothetical.

He intends to petition for his new wife and his children so it'll certainly come to light either way.

I Hope you were joking when you said this. If not i would really love a source so i could be enlightened as well. As far as i knew the mother was shunned/bad-mouthed.

Also i have seen a trend here on VJ recently, people take out pitch forks very early. You guys do realize venting your anger at an internet post won't really do much, Yes the OP lied on his application let us try to move on from that and tell him politely, Hey OP You Got Lucky Once, You really want to try your luck again. Because you will get caught in your lies and mess up your case.

See simple.

It would be highly insensitive and I humane to joke about it. Not sane person would do that.

I tried to find the BBC Documentary in archives but haven't had luck and enough time to research. But here is the source along with many more article that you will find with simple Google search.
