F2B beneficiaries and DV lottery participation.

Timeline

Greetings from Kenya. I am asking on behalf of my cousin. He is a beneficiary under F2B category but his date has not become current. He is aware that he cannot marry until he immigrates to the U.S. He has a lover and wants to know if he can apply for the DV lottery 2018 as a married person and if he is lucky and wins will it affect the F2B petition that has not become current? If he does not win, will he be penalised in the future under the F2B petition that he applied for the DV 2018 as a married man. Kindly advise.

that's fraud, he isn't married

or he's married or he's single, he can't lie on any type of visa. immigration, both petitions will be in the database, so one will say he's married and then the other that he's single, he is committing fraud to obtain a benefit for his lover

if his country qualifies for a DV, he must file as unmarried, or marry and forfeit his F2B petition and gamble, since the DV is a lottery

his information must be consistent in both petitions, or he will be denied

Assuming that he has the country ties and education/occupation to apply for the DV lottery he can apply as single and if he is lucky and wins he could marry then. He would need proof that the fiance has been in the picture before ( not just someone he is giving a help to the US ) that way his F2B carries on because there isn't a very high chance of winning a DV.

This will not be over quickly. You will not enjoy this.
