K1 Visa denied to my Filipina Fiancee

Well I just joined this forum and don't have very much knowledge on visas like the others in this group...but it appears that it will.

But....if that is all you have on your record then maybe you will be ok?

My fiancée called to see if her papers have went through processing.

They said yes...and they let her schedule another appointment for October 4th.

On September the 8th they told her to go home and think hard and make sure this is what she wanted to do and talk to me and make sure that the assault on a female will never happen again then call back the embassy's landline and reschedule.

No one has ever heard of this and I thought she may have misunderstood what they was saying or in some way they were gently denying her the visa and was going to let it fade away...but sure enough...she was right!

When she goes back they told her to bring her passport and the papers she brought before and go to window 31.

Keep us in your prayers...hoping it all works out this time!!!!!

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Definitely. They don't like to see VAWA at all, they have a responsibility. I read what you went through amd I definitely understand but I she, you should go amd be they're for next interview and out your point across as well.

  • May 4 2017. Approved without interview, Card being Produced
  • May 7, 2017 recvd approval for i485
  • May 10 2017 rcvd Green Cards in mail.!!
  • Next step in 20 months to remove conditions.

 

Removal of Conditions Begins by end of first week of February

 

  • February 5, 2019   - Printing package;
  • February 11, 2019 - ROC package mailed;
  • February 13, 2019 - Package delivered to Dallas Tx;
  • February 15, 2019 - Credit Card Charged;
  • February 19, 2019 - Electronic Notification Rec'd, Case Location LIN - Nebraska;
  • February 21, 2019 - Received NOA with 18 month extension for wife ONLY, not 14yo dependent who is on application;
  • March 12, 2019      - Notified USCIS that we never rcvd i797 for 14 yo minor, they provided a case # and submitted a Svc Request
  • May 2.2019             -  No forward motion, we called again and despite there was an officer assigned to this service request nothing happened/ no extension. We filed an InfoPass and have an appointment for Monday 6th for passport stamp.
  • May 6, 2019 - Attended InfoPass appointment in Philadelphia local USCIS local office for 930. This was for a never rcvd 797 for our 14yo dependent. Arrived 9:15, not crowded at all. No extra photos or fingerprint taken. We were in the car (lots of parking available) at 945. Pleasant female officer, she updated and checked for no changes. Stamped passport, explained is valid for 1 year. The took the green card which expired 5/4/19. No issues or problems.. I asked about the non receipt and she said it's pretty common.. 
  • August 23 - Biometrics NOA, scheduled for 9/3 @1pm
  • September 3 - Biometrics
  • September 4 -Fingerprint Review was completed
  • January 8 - ROC, Card Being Processed, Citizenship is next!
  • January 15 2020  - Cards Delivered

 

N400 Citizenship :)

 

  • November 28, 2020     - N400 Filed online and paid via CC
  • November 28, 2020     - NOA received electronically

I a will probably need to leave by October 2nd and fly to Manila and meet her there ...I am not wealthy and get paid monthly. I will not get paid until October 1st....I am hoping they will have a plane ticket left.

I will be there if at all possible because if she gets denied I know I will am myself.

I just had 2 week notice....Grrrrr

I thought about having her to call back today and ask if she can go the following week...to give me a little more time???

I would not risk that, they may just say forget it and refuse her. You are walking on very thin ice here and I am surprised they are giving her

another chance. Don't blow it. This is all more fragile than you think it is.

OP you have been given a rare second chance. I myself would not pass it up and from the quote you sent earlier of your fiancé email, I wouldn't call her fluent in English and this case is not simple. You being there with the letters, notarized from your ex wives may get your love a visa.What has changed in the few weeks since her interview? Put yourself in the COs position.

I think you have some things to think about....this process is not cheap. I know everyone has limits , but a flight to Manila in two weeks wouldn't be one of mine, maybe see if she can reschedule latter to get things squared away with work leave and a cheaper flight

I agree too, he needs to be there and maybe his ex letter notarized or his witness letter notarized, maybe even write his own letter apologizing for the past and promising he will never do it to his future wife and he is not drinking alcohol for years, maybe he needs to write this kind of letter and sign, notarize. To be there, it's a great support even if he is not allowed to be in the interview, she's telling he's waiting outside and handling his letter, it will look better maybe

Well...they both agreed to help me and sign the papers and get them notarized saying I was not a violent husband. Now they have both changed their minds after I called them both today and told them I was on way to have them to sign the papers.

I guess they think even though they don't want me...they don't want me with a beautiful young asian woman when we meet together during school activities for my 11 year old from my second wife or to a wedding of our oldest 2 boys from my first wife.

They both know I am a good man...I don't think they are jealous but the only reason I can think of is...my new wife will make them look bad...I could be wrong???

I don't know why they BOTH changed there mind???

Oh well...God knows my heart and the truth...I will be at the interview to honestly answer questions and support my fiancée.

My supervisor said he will support me and give me what ever days I need off to take care of this!

It is perfectly within their rights to not ethically or emotionally entangle themselves with your new marriage. If they had provided these statements it would be above and beyond what an reasonable ex spouse could be expected to do by far.
