Harpa: Not sure never bought ice or any drug in thailand, but the facility I am going to put her in is on an island 100+ miles offshore. Not saying drugs cant be snuck in, but it is going to be harder. She is going to be staying in a bungalow with her mom and her kids and she will be in from 4 to 6 months. If she gets in bangkok and dont want to go, the police can detain her, test her for drugs and force her into treatment. The reason you send her back is so you can force her into long term treatment even if she dont want to go at first.

First off, her friends are not going to protect her. They are scared shitless of me. The thai counterpart has already been paid a visit from people I lnow in the thai police. She is on the run for human trafficking. She is no longer working "escort/massage" here because the people she worked for is scared shitless of me. They would already be un jail if the pasadena police would follow up with arrests. My PI handed them an arrestable case, but nothing has been done.

I agree about the rehab facility that is why she is going to a facility in Thailand that is ranked in the top ten in the world and was recommended through MAYO clinic in Phoenix.

As far as the life change, that is up to her. I can only do so much, but she cannot take her I 693 test until she gets clean. I know a lot of people disagree with my idea that she is a victim, but she did not use and was not involved in prostitution for the 6 years I knew her prior to having our 2 children, it was only after she went to work for a Thai owned japanese restaurant in Chicago. Within in a month she was on meth heavy, had a personality change and had started working for a "sexy massage" shop. I am not done with them yet, hell is where I am going to put them.

We will have to cross that bridge when we get to it. For now it is about getting her clean and having more tools to do so.

What happens when she can't get a new green card because of her prostitution? Will you and the kids move to Thailand to be with her?

I understand that your family is in a terrible situation with her recent actions, but I'm not sure what you are hoping to gain by refusing to sign the I-751. If you are hoping that by not applying for the I-751, then she will be deported, I'm afraid that isn't going to work. The chances that she will be deported are so slim that they are almost non-existent. By not applying for the I-751, she will just become one of the many millions of people here without legal status.

You're not going to be able to force a deportation, you can't force her into treatment, and you can't force her on an airplane either. Unfortunately, she will have to willingly seek treatment, either here or in Thailand.

If she leaves the country without removing conditions, you will need to petition for again as others have stated.

She can file an I-751 on her own with a divorce waiver, no need for your signature.

She does not have to be divorced at the time of filing. Once USCIS gets to her file (several months after filing), they'll issue an RFE for a divorce decree.

Even if no I-751 is filed or one is filed but gets denied, this does NOT mean automatic deportation for her, merely a loss of her LPR status.

You seem to think that you have complete control over her immigration status/potential deportation. You are wrong.

like the op said , she has just 14 days to file divorce waiver. i think his plan about i751 might work and comes from his heart for her greater good. op follow your intuition . may be it will work to get her clean and back in your life.

I realize she can file without me, but they are not going to grant it if I have not signed it right? Acording to the law, the fact that she is a drug addict and a part time prostitute of which I have evidence of, would make it extremely difficult for her to make a challenge on any basis. Her immigration status is my only tool and I am doing so with complete agreement from her parents. My attorney already explained that her involvement and the evidence I have of her involvement in solicitation will preclude her from being able to mount any defense. Just wanted a second opinion.

Are you planning on sending the "evidence" to immigration for them to deny her ROC? If they find out about the prostitution and/or drug addiction, you better start packing because you will be moving to Thailand since she will probably not be granted a US visa with a prostitution and drug addiction history. I say "probably" because anything is possible with the US government.

Also, sending somebody to Thailand to recover from drugs and prostitution? The place with the worst vices on earth. Now, I have heard it all.

Why not just pick up and move to a different state? I'm sure her "friends" wouldn't follow.

You can only help so much. At some point, she has to want to get better. If she doesn't, are you going to ruin your life and your kids lives to "try" to help your wife when she clearly doesn't want it? File for custody, cut her loose, and let nature take its course.
