Fiance lost citizenship through divorce, now wants to marry me, age gap (split)

Sorry divorce will not in and of itself result in loss of citizenship. Oh, I just reread what you said and I figured that you meant citizenship. :) People from Bangladesh are notoriously hard headed and self centered. Its likely possible that he is only hearing what he wants and ignoring the obvious that his new lover is obscuring the facts and not telling the truth. I would not paint an entire country of people with such a broad, negative brush. Her divorce will not result in loss of citizenship unless there was fraud. Or it seems if her ex-husband lost his citizenship, butthat was not the case according to the OP so the loss of citizenship still doeesn't make sense. Now because she obtained citizenship in 2009 and assuming she removed conditions in 2011 (there is no removal of conditions AFTER citizenship. Citizenship is the final stage, preceded by the ROC) she would already have a permanent green card thus there is no way she could lose her citizenship that was obtained later UNLESS something severe happened and divorce would not have triggered this. Someone is lying heavily here! (I would agree with that!)

This is an interesting one! Talk to your girlfriend, mithukhan432. If she still thinks she lost her citizenship (very unlikely, if not completely impossible), then it may be worthwhile for her to talk to an attorney to help her understand. She's either misunderstanding her status, lying, or her ex-husband is lying to her. Maybe there's even some miscommunication between you and your girlfriend. I hope it comes down to a simple misunderstanding.

or, maybe she had lost her permanent residency because she breached a rule and there fore had to re-apply for her green card and then US Citizen ship ?

It doesn't sound right to me and it seems some detail is missing. A permanent resident cannot bring a spouse or alien into the USA. that is only a right that US Citizens have.

I strongly suggest you seriously consider your "Bona fide" relationship with this woman as one of you isn't telling the truth or doesn't fully understand the other persons situation. You also should not refer to her as your "us citizen girlfriend" that seems odd not only to us here, but to the USCIS. Likelihood , someone is lying and it's going to be a strange case and possibly a waste of time and money if found to be not legit.

You need to get her to be honest with you and you also need to learn to take advice from people on here whom have been dealing with this kinda thing for years.

It doesn't sound right to me and it seems some detail is missing. A permanent resident cannot bring a spouse or alien into the USA. that is only a right that US Citizens have.

LPRs can bring their spouses and under-21, unmarried children. There is some wait involved as no visa numbers are immediately available for them. They have to wait for their Priority Date to become current. For spouses it's about 2 years.

I can think of no case where a removal of US citizenship, a very serious issue, would then result in a GC. If someone has an example where it has happened I am all ears.

There are very limited circumstances, but it's in the regulations, and it has been addressed by case law. There is a statutory bar from rescinding a person's permanent resident status, even when it was acquired through fraud.

The basis by which someone can keep his/her green card (through AOS) despite fraud:

If, at any time within five years after the status of a person has been otherwise adjusted under the provisions of section 245 or section 249 of this Act or any other provision of law to that of an alien lawfully admitted for permanent residence, it shall appear to the satisfaction of the Attorney General that the person was not in fact eligible for such adjustment of status, the Attorney General shall rescind the action taken granting an adjustment of status to such person . . .

There's no such statutory period to prevent the revocation of someone's citizenship:

It shall be the duty of the United States attorneys for the respective districts, upon affidavit showing good cause therefor, to institute proceedings in any district court of the United States in the judicial district in which the naturalized citizen may reside at the time of bringing suit, for the purpose of revoking and setting aside the order admitting such person to citizenship and canceling the certificate of naturalization on the ground that such order and certificate of naturalization were illegally procured or were procured by concealment of a material fact or by willful misrepresentation, and such revocation and setting aside of the order admitting such person to citizenship and such canceling of certificate of naturalization shall be effective as of the original date of the order and certificate, respectively

You probably have no idea what you are talking about. So let's make this clear to you:

- once you become a US citizen you does not change.

- you can get divorced x number of time and no matter what your spouse does, it will have no impact on your immigration status.

All the information you are providing to get some suggestion are based out of incorrect information and I don't think anyone can give you the right information. So please find out the right information and then people's with similar experience can help you. What you are saying just doesn't make any sense as that don't happen either by law or by any chance.

You can always get married and depending on her immigration status the application process will take different amount of time (IR1/CR1 could be a better/safer option). During the entire application process you will be need to prove your marriage in various ways and finally have to convince in person at Dhaka Embassy. Age would not be a big problem but questions will come as that. It that common in Bangladesh, but it's not a deal breaker.

For you to appear before an interview will probably take long time if she didn't file an application yet. For IR1/CR1 this may take 9 months to 5 years for you to get an interview drowning in her status (GC or citizen) and if you visit the step by step guide here: http://www.visajourney.com/content/i130guide1

. As you will be filling the I-130 form, this will also state what USCIS will need from you. After you are done with USCIS then NVC will let you know what they want and when they are satisfied, your case will move to Dhaka embassy.

So get your story straight and the. Think what you will do. If you get the VJ users confused, I can't imagine what you will do the the visa officer. So please make sure you know the entire process first and then know what you are doing, else you will just get into trouble.

Actully my girlfriend's ex husband take her USA by k3 visa, Then she got Green Card. After 3 years she applied for Citizenship (as a spouse). I think she deserve it for her ex husband. But now they are divorced, I think for this reason, She lost her Citizen and now she's preparing for reapply to get citizenship again.

My worry is we are thinking to marry without our family permission and i'm doing a government job in Bangladesh police department and she's older than me. Is it really have any hope to approve visa??

is there any restriction for government employee to get immigration in U.S?

She didn't lose her citizenship through divorce. If she applied for citizenship and became a citizen before her divorce, she's still a citizen now. There is no reason for her to reapply for citizenship because simply divorcing someone does not strip you of U.S. citizenship.

If it's a legitimate relationship, you have nothing to worry about with respect to age and family permission. There are no restrictions on foreign government employees immigrating to the U.S.

Did you read any of the past 5 pages of replies to you? It is not possible that she lost her citizenship because she got divorced.

Why would you need permission from family members to get married? You're adults.

You seem to be very concerned about your chances of getting a visa. To the point where it looks like you are just in this relationship to get a visa. If you genuinely love this woman and want to marry her and spend the rest of your life with her, you have bigger issues going on that you need to resolve first. If she told you she lost her citizenship through divorce she's either lying to you or is seriously confused about her status. Have you met her face to face yet? Has she asked for money to help get her citizenship back?

I actually think you are being catfished here. I don't believe she's in Michigan or anywhere else in the USA. What job does she do?
