Can we petition under special circumstances for my husband's 17yo brother to come to the USA to live with us? His brother's father died two years ago and their mother died last week. The brother now has no parents alive and is living with his 23yo sister who is not taking care of him or ensuring he finishes school. My husband was legal guardian of both his sister and brother about 10 years ago until the father got his act together.

I brought my husband in 2013 on a fiance visa and we have changed status to a 10 years green card holder at this point. We are beginning his citizenship process right now.

nope, no special circumstances, he has to be a USC to petition for his brother and the petition will take over 12 years of waiting

his age is irrelevant and there are thousands of other sibling petitions waiting in line with few GCs available each year
