K1 CASE LOST BETWEEN USCIS and NVC

Sheer frustrations have compelled me chime in on this topic. Greg, I am in the same situation that you are in. I129F (NOA2) was approved on 7/08/2016 and still no case from NVC. All inquiries to USCIS and NVC are met with canned responses...utterly useless. Emailed NVCResearch and still no response after 2 weeks, which is to be expected (sadly). Just enlisted the help of my congressman in hopes of getting some answers (crossing my fingers). At this point, I'm hoping that my file is backlogged somewhere, but hey, let's just assume the worse and that it somehow vanished. I'll be a good citizen and just proactively reconstruct my I129F petition right now!

Ok, enough of the rant (sighs). Those of you who are experiencing the same thing as Greg and I, I assure you we share the same frustrations. My fiancee is expecting our first born in April 2017...I really hope the government of the greatest country in the world doesn't let me down.

I appreciate the support and encouragement. Very sorry to learn that you are suffering through the same madness as we are.

I learned over the weekend that more often than not, "lost cases / paperwork" are usually sent to an offsite storage facility mistakenly. The success of finding the lost paperwork hinges solely on the motivation of the individual looking for it. Ugh!

As of yesterday (12 September) we still have nothing. My congressional representative has had our case for three weeks now. They aren't very communicative and the immigration liaison spends a lot of time out-of-the-office. Grrrr!

So I finally got a response from NVCResearch. No good news at all. Here it is verbatim:

Dear Sir/Madam:

The National Visa Center received your inquiry and the attached I-797 Notice of Action - Approval Notice. Unfortunately we do not have a record of receiving your approved petition from the U.S. Citizenship and Immigration Services (USCIS).

NVC will work with USCIS to determine the location of your petition. We will let you know when we have more information. You do not need to take any action at this time. Thank you for your patience as we work with USCIS to ensure your case is moving forward.

I disregarded the response. I'm banking on my senator's immigration liaison team to get done what NVC and USCIS can't.

Ok,

Here's what I did (that congressional office probably won't help much BTW):

1. Put in a service request with USCIS as soon as I could. You should do the same if you haven't yet.

2. After getting a useless answer from that service request, I e-mailed CSC-NCSC-FollowUp@uscis.dhs.gov to tell them how useless the service request was. They responded within a couple days, claiming my petition was finally on its way to NVC.

3. When that proved to be false, I forwarded those e-mails to CSC's "boss": SCOPPSCATA@uscis.dhs.gov pointing out how bad the service had been. They responded within a couple hours, telling CSC to get its together. CSC promptly replied, saying my petition was on its way. This time it proved to be true, but since it had been BS previously:

4. I also e-mailed the USCIS omsbudsman, who also immediately wrote back to me, saying she'd look into it. A couple days later she confirmed it had been sent out to USCIS.

5. I arranged an infopass meeting at the local USCIS office, which also confirmed what the ombsbudsman told me. At that point, I finally felt a bit of relief and hope....

I should note that I started doing all that in October, and it was resolved in January. My only regret is not doing step 3 a little sooner.

Basically your situation is 100% due to USCIS and not NVC. You have to keep the pressure on them. As you can see, NVC will just do nothing about it (nor can they really).

Quite remarkably, this is the most solid advice I have received so far. Very, very helpful. I can't thank you enough for sending the actual links / email addresses. I will get on this ASAP.

Incidentally, it has been over nine weeks since our I797 approval. NVC research has yet to respond, and the internal USCIS investigation is worthless. I pulled my senator's immigration liaison team in three weeks ago and even they have turned up nothing. Its as if we just ceased to exist.

Hey all,

Got an email from my congressional representative today informing me that there have been server / database issues at USCIS CSC and as a result, the investigation into our lost case is delayed. Just my luck, right?!?

On a whim, I called NVC this evening expecting the same response I've received the last hundred times. Guess what? They received or case TODAY and already had an MNL number assigned. Can you believe that? Woo hoo!!!!! We are finally moving forward. praise God!

I emailed the immigration liaison conducting the investigation via my senator's office and told her she has one less thing to do next week. Haha.

I called Dyn in the Philippines and woke her up. When I told her the good news, she broke down and cried like a baby. Through heavy sobs and a runny nose, she said she felt a wave of relief wash over her. I agree. This chapter of the tragic USICS vs NVC ordeal is behind us.

Congrats! You did it right by getting your US congressperson involved. I know everyone around this forum usually advises people to be patient but sometimes there are real, legitimate reasons for delays and cases are indeed temporarily lost. You are your own advocate in this process. No one else is going to push as hard as you.

September 16 2016: NVC received approved I-129F petition and assigns case number

INTERVIEW / MEDICAL PROCESS

October 04 2016: Day 1 of medical at SLEC in Manila

October 05 2016: Psychiatric evaluation off-site due to psychological incapacity annulment (10 hour eval with 800 question profile test)

October 13 2016: CFO Seminar completed successfully and certificate awarded (CFO stamp not issued until visa is presented).

October 20 2016: Return to SLEC complete psychological evaluation with resident psychologist (less than ten minutes)

October 21 2016: Vaccination day at SLEC (medical finally complete)

October 25 2016: Visa interview at USEM in Manila (APPROVED)

HOMECOMING

November 19 2016: Dyn's arrival at POE Dulles IAD in Washington DC

December 01 2016: Married
