Unused expired K1 on passport ,can I visit the USA for a few days?

OP: You are getting way too worked up over this. You most likely can visit because you have visited and left many times before. Worst case, you get turned back, then you do the fiance visa and live permanently in the US anyway.

It's a beautiful Sunday. This is nothing to get worked up over.

I honestly don't think you've got anything to worry about.

Yes, you have strong ties to the USA but so do I. Like you, I also have a good track record with my visit. Over 40 visits and never overstayed. Never been denied. And I have a husband in the US, which is one of the strongest ties you can have. I have not much here in the UK. I rent one room. I don't own any property or a vehicle. I have no children. I don't even have a goldfish. I do have a very good job which I very much enjoy. On the face of it, I don't have much to keep me here considering my husband is there but I have always returned when I said I would. Never had a "change of mind" and decided to stay.

But like you I worry about these things. Lately I have been asked to show my return ticket home (they never used to ask to see the actual proof of reservation - they would just ask when I was going back)and also been asked how much cash I have with me. I never carry more than 20 dollars with me when I go through airports. The risk of being pick pocketed in a crowd is too high. So I just have a bit of cash for snacks, drinks and magazines. I have noticed that when I tell the CBP officer that I don't have much cash with me but I have my UK debit and credit card with me, that pleases them. It shows that the accounts are still active and that I haven't liquidated everything and left the country.

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Actually, it isn't a mess. Why do you continue to make comments about subjects you know nothing about? You continuously overreact and when you do you cause undue stress and worry to others. If you don't know an answer, simply don't answer. Period.

First. What you can do is get a new passport. Bam..visa is gone. That will avoid any questions if the CBP office sees the K1 visa. And it gives you a clean new ESTA

Second. Parents of a US citizen can get a green card. So, you have that as well for the future. It's a good thing to have a US citizen kid.

Third. Apply for the K1 when the time is right ?

Fourth. Always be honest to the CBP officers. People got into trouble for lying. Even the most silly lie like saying that you are visiting your girlfriend/boyfriend instead of fiancée/fiancé.

New passport is not necessary. People are allowed to change their mind and better have an unused visa in your passport than a broken marriage that was entered into too quickly. Even if he gets a new passport, he will need to declare the previous visa when he applies for the ESTA approval. You don't seriously think they won't know it's the same person, do you?

Child is only 9. If she decides to petition her father it will be another 12 years plus the 1 year processing time (under current processing times - in 12 years time that may not be the case and it may be that green cards for parents are no longer available by then. Who knows?). He is asking about how he can travel NOW to take his child to her mother's, not how he can get a GC in 13 years time.

Applying for the K-1 when the time is right is good advice to everyone considering it. I'm sure he's learnt his (expensive) lesson on that already.

With the number of times he has entered I'm pretty sure he knows not to lie. He has a lot at stake - his child is moving there so he knows he needs to stay on the right side of CBP every time in order to visit his child.

I don't think anyone purposely gives out the wrong advise it's just sometimes you repeat something you heard. I am sorry if I upset the OP I was just commenting to him on his post no where did I direct him to do anything all I said was what a mess ....he himself stated he will refile the K1 at a later date that is convenient for both he and his fiancee and all I stated was if you can't come in on your esta then I guess refile the K1.

I find this place a great place for support and to gather lots of information. I am thankful because here I got the info I needed for my RFE.

If I offended the OP or caused him undo stress I'm sorry....:huh:
