She is a dream just like her name suggests. It's time to find and serve her the divorce paper. In Vietnam, you just don't marry the girl, you marry to the whole family. Unfortunately, you chose the wrong Viet girl, or may I say the wrong Viet family to marry into. Lesson learned, and move on

OP, first of all my heart goes out to you, I truly believe most of us started this journey to find something different than the westernized self centered , self serving, non sacrificing people we have met in life to date. however, people are people all over the world and as others have stated she is not worth a minute more of your time. I don't pretend to know the family laws in PA, i would agree with the others and file ASAP..so the one year clock starts. Time is truly are most precious commodity.

Hey Dave,

I have read your original post a while back and wanted to wait before giving thoughts. I have a close friend of mine who went through the same situation. He reported her to USCIS (giving all her info) and detailing exactly the situation. When it was time to apply for ROC she was denied for marriage fraud. I think you should report her.

PS: since she's been missing for month, she is considered a missing person, you should try to report her missing to the police, that way they can look for her and you will be able to have her physical location and hopefully she is safe and alive

Well the wife won't be around to object anyway :P

And many things could have happened during her many months long disappearance

e.g the door lock has broken or OP lost his keys for safety reasons need to change the lock etc

Changing the locks is not illegal based on the circumstances in this situation. The op's wife has taken up with some very shady people and he has every reason to fear for his safety. If the wife wants in the house to collect her belongings, she can come back with a police escort. If I were the op, I wouldn't allow her back without the police present at this point.

Getting in trouble for changing the locks on his house is the least of the OP's worries.

She has given up residence by her prolonged absence. He's totally within his rights at this point to change the locks. Just because she's still legally married to him, does not automatically give her rights to his home. She has taken residence elsewhere.

It would be illegal if he was trying to illegally evict the wife/keep her out, but that is not the case.

He may have more important things to do like file seperation legally and report it to uscis so maybe she is not able to do the ROC because she obviously used this man for a greencard. Id start by info pass, seperation in court, locks changed and when he divorces her he does not need to Serve her if no know address he can have her notified in the paper he will have to run three ads but the lawyers can handle this. If you revoke her stay here by having this marrige declared fraudulent he will not be on the hook for the afidavit aswell soon as removal preceedings began.

PS i would cancel any life insurances god forbid this woman is not done screwing this man

He may have more important things to do like file seperation legally and report it to uscis so maybe she is not able to do the ROC because she obviously used this man for a greencard. Id start by info pass, seperation in court, locks changed and when he divorces her he does not need to Serve her if no know address he can have her notified in the paper he will have to run three ads but the lawyers can handle this. USCIS does not recognize local court findings of fraud. The standard of fraud they use is much different than the varying standards used by state courts. USCIS will make its own determination on that issue based on its own rules and standards. We have had plenty of people here try and fail to make a local courts findings stick with USCIS.

USCIS does not recognize local court findings of fraud. The standard of fraud they use is much different than the varying standards used by state courts. Yes it is, but I don't want people wasting time and money thinking getting an annulment based on fraud will have standing with USCIS. I don't think they even bother to look at those, given the results people have reported back. I also found a reference once, I think in the handbook, which stated a USCIS agent should not consider a local court ruling and following the standard process.
