Im pretty sure he just abandoned AOS ststus he will not be allowed entry as before he is married now. Youll need to go through the embassy.

hope that helps f1 is for non imigrant intent hes married he would be intending to migrate.

They can send it to me to U.S. consulate or embassy or USCIS office in my home country. It won't change anything?

You cannot leave US until you get the AP after filing i485/EAD/AP. If you leave before you get AP, then your AOS is considered abandoned and will subsequently be denied.

If you leave US before your AP is issued, then the only way you can come back to US is by going thru "follow to join" benefits with USCIS and then thru the embassy to get the immigrant visa.

The thing is that I have option to pick up AP document in my home country, because they will send it there if I ask them. I will pick it up from U.S. consulate or embassy or USCIS office.

In this situation I will a priori leave the US without AP document in my hand.

So should I wait for some letter of AP approval of check AP status online and then go, when it says accepted or approved or issued, or I can go right after I do biometrics

Who told you that you can pick up the AP from the embassy or consulate of Uscis local office in a foreign country? USCIS will mail your AP to your address in the US.

There is a line to fill in form I-131, advance parole paragraph, saying

His only step is for you to file for him as a spouse of US CITIZEN OR LEGAL PERMANENT RESIDENT. CR-1

If you are a citizen his process will take about a year if not then longer.

No point trying to get by CPB officer upon entry he will be asked questions and when they see he is married he will be denied entry since f1 is not a visa for people who intend to migrate.

File for him as your spouse once he HAS his embassy appointment then if you qualify he will be issued visa as your spouse.

If you do anything else to get around it will be ILLEGAL.

There is a line to fill in form I-131, advance parole paragraph, saying

That's only for some specific cases For some people who are outside the US and are seeking an AP to travel to US temporarily. It's not for general cases like yours so not applicable to your case. Read the instructions.

OP's husband is getting the employment based GC and she is the beneficiary. He travelled using his AP. We r just trying to advise her not to travel befire she gets her AP.

I understood her husband left the us before he got his greencard and she applied for AOS. For him.

Does anybody know what stage or I-131 processing I can leave the US?

Should I wait till the very end when they send me physical AP document or I can wait only for some status update online to accepted or approved or issued? Or I can travel after I have some approval letter in my mailbox and then somebody will send me AP? Or I'm good to leave after biometrics , when their decision is made?

You can leave when you have AP in your hands. If you leave before your AOS will be considered abandoned. You were told all this before, is there a reason you can't stay put for 90 days it takes to get AP?

Don't count your chickens before they hatch.

The safest route is to wait until you have the AP card in your hands.

What's the emergency?

I have some reasons accumulated while staying in the US, but i don't know if they qualify for emergency AP request. Its not that serious as a Severe financial loss to company or person or somebody's death.

One of the reasons is my grandfather whose last name i have , he had surgery about a week ago.
