I didn't come here based on marriage. I was working on H1B since 2005. When my husband became a USC in 2009 I filed an adjustment of status thru I-485. I had no records of him to list.

Just last year I found him. Now I am looking to bring him here. He is 20 yrs now. I didn't want to complicate things.

Please any one could possibly help me with potential issues. I thought I only have to give them the birth certificate along with my naturalization document and US passport. I didn't have any details of him to list in N400 with supporting document to USCIS. This child was born when I was 19. My son's father family took the child away and I went back to school.

I don't have any reason to "lie". I had been in US more than 11 yrs now. I came here for working and I am reputed entrepreneur and director of big IT company. There is no reason for me to lie just to stay here in US.

I didn't have any information about him to list. I couldn't go back to my country to find out all the information. I was pregnant with my daughter when I filed for GC. Since I didn't have any information and he was born out of wed lock. So, I left it at that. Period. Please don't judge people.

We are all here for one common goal.

Thank you. He was born when I was 19 out of wed lock. I was afraid to list him as my son during my N400 citizenship process. I do agree that there may be a DNA test required. Which is perfectly fine since I'm his mom.

I badly wanted to file now since he has all the paper work. My family also supporting to bring him here. I will file them in 2 days.

Do I also send them the financial statement for the proof of supporting? I have that.

I don't have a pics of him and I to send it.

Uscis.gov website says I can also file for K-4 visa (Form I-129F) along with I-130 so he can come and live and go to school. Is that true?

Please I request you all experts to help me. So he can see me and have a family here.

And now again you did not know of him until last year...if you timelines correct you applied in 2012 for your n400 thats not last year.

I am not sure what story you wanna spin but the CO will be more vigilant then i of this. And if you have any other children be careful to list them all this new time to update.

They take very serious here leaving information conviniently out not sure for what purpose but had you not know his info you could put down unknown where abouts of 20 yr old son.

You had to atleast name him if your name is on his birth record. I hope your name has always been there or that will be a def reason for a DNA.

I hope you can get this story straight and have one version

No ones judging we are asking you whats up the CO will be tougher buck up

I filed my petition in 2012 when I didn't have any information about where he is and birth certificate. I only have him and my daughter that's all. I came here for work and filed adjustment of status when my husband became USC. I will handle it if there will be a qn asked when I file petition. I don't need this discouragements and nasty judgement from any of you.

But you did lie by omission. You knew you had a son, you knew the bday presumably. You probably knew his name. You could have written that and explained that he was lost in an explanation sheet. Now you have a conundrum because you did not disclose this and you want to petition him.

:wow: i was NOT :no: being nasty everyone on here has tried to get your story straight but even you have issue making heads or tails of it.

You will have to explain all you are stating now to the US government not us. You asked a question we have answered i answered wrong early on and apologized.

You said your husband took your child at 19 so you at least had to know his name and date of birth you left it out i dont know where you go from here other then apply and see if they even notice if so give them answers and if tou think we are nasty you may think the same of them so adjust your feelings so you dont call them Nasty aswell..

Be prepared to be heavily questioned and scrutinized. If you think responding to the question on an internet message board, imagine sitting in front of an immigration officer who is looking for any evidence of red flags. The other posters are correct, your story isn't clear , concise, nor accurate and omission of information about your son when it is directly asked on the immigration documentations IS considered a lie. Posters on here aren't professionals and were able to discover discrepancies in your case just by the little information you wrote here.

My point is take your experience in this thread as a prerequisite of whats to come with immigration and prepare to be heavily scrutinized.

Woman for decades have given a child born when they are too young to others and many find this child ( or get an odd knock on the door ) years later. I am sure this isn't the first time this has happened where one of the two parties has also been an immigrant to the US.

This will not be over quickly. You will not enjoy this.

BlueHills, sorry about the not-so-nice responses you've gotten so far. People on this website tend to attack when they even think there's a lie going on (just because in order to keep this site reputable we MUST ALWAYS DISCOURAGE/REPORT FRAUD in any shape or form).

I, however, think I understand what you are saying. You had a child very young and were never in that child's life. So when you filled out the AOS paperwork I can imagine that years later...you wouldn't even consider that child. But now you and that child have reconnected and you would like to be in his life.

Even though I as a person understand that, there is no guarantee that the USCIS will understand that. Since there are so many ways for trying to get around USCIS laws, expect them to give you a hard time as to why you never listed him in the first place. I do not know just how difficult your case will be, since I think it depends on whether or not the officer who reviews your paperwork believes you were trying to commit fraud.

As far as the DNA test, i'm not sure if that is necessary since you have access to his birth certificate..which is a certified document showing as proof that this individual came from your body.....why would you need DNA? I'm not sure however so if I were you I would at least try to include the DNA evidence if you can get it in time.

  • On Oct 13th AOS status was updated to say that a notice was returned due to post office being unable to deliver it. Tier two told me that it was biometrics or NOA1 (even though I had received both before this date).

  • A few weeks later I received a notice dated Nov 10th, in regards to my call about the Oct 13th notice. The new notice said that there were no RFE's or withholding on my case. So still not sure what this Oct 13th notice was about.

  • Received a letter from a NY office on Dec 23rd (dated Dec 10) stating that my medical was over 1 year old. (At this point my medical was only 7 months old)

  • Teir two submitted an internal service request to which I got a response telling me that I need to respond to RFE ASAP

  • Submitted another service request on 1/6/17. To which I got a response on 1/19/17 stating that my case was pending and is outside of processing time (no mention of RFE)

I didn't think he will even approve me as mom years later. I wasn't intending to hide anything. Now I'm trying hard to being accepted and want him in each other lives. After reading these posts, he says mom don't worry about it. I am fine here. I don't want you and sister to go thru anything becas of me.

Like i said buck up everything from here is answering questions i dont belive anyone is telling you that he cant come or that you intentionally commited any fraud just that you will have some explaining to do. All you can say is the truth.

You will be fine. And i hope your child young man can learn to love you and except what happend in the past. Mom is only one.

I would seek legal help prior to sending anything out. Read this article. I dont know if what you omitted is a problem
