AOS TIMELINE SO FAR:

  • Arrived in US on K1 on January 29th
  • Married in Georgia on February 16th
  • Mailed off AOS including AP and EAD forms on February 20th.
  • Recieved text that "case was received" on March 4th.
  • Bio-metrics was March 31st in Atlanta.
  • Received "request for Initital Evidence" on April 5th (mailed March 31st) which we returned April 6th (very mad at ourselves for sending the wrong Affidavit of support)
  • "Case status" showed they had received the correct Affidavit of Support on the 27th April.
  • "Case status" now showing "ready to be scheduled for an interview as of May 11th - no interview letter received as of today.

Still no AP or EAD (it has been over 12 weeks since we mailed the application, over 10 weeks since it was "received", and almost 7 weeks since biometrics)

K1 expired on April 29th - as did my temporary GA drivers licence. I believe I can get another licence with my EAD (when it arrives), but nowhere says this for sure....?

So yeah, how much longer? At least for my EAD, I can manage without the Green Card for now. Some sites say 45 days (which would have been 4 weeks ago), others 90 days (so roughly another 2-3 weeks).

My lovely husband has awesomely been supporting us both for the past 16 weeks, but things are getting tight, plus my drivers licence has expired so unless I want to drive illegally I'm pretty much stuck at home, not that I have the money to do anything, and I'm bored, really really bored.

Also I see some cases on here that applied for AOS around the same date as I did (give or take a week or two) who have either already received their Green Card or had their interview at least - does it really vary that much from case to case? I know our mistake with the Affidavit cost us about 3 weeks on the Green Card side, but I'm in no rush to get that if I can get my EAD which SHOULDN'T have been affected by the Affidavit mistake.

I'm really worrying about how long this is taking, and seeing the stress the financials are putting on my husband =(

At least I know when I get my interview date I should have my Green Card within 3 weeks.

90 days is the usually stated norm.

You received an RFE in April, the processing time comes to a short pause until the RFE has been received and will be looked at.
Middle to end of June would be my guess and maybe sooner.
It was 55 days from when they received our RFE. Our RFE was also for the affidavit of support and yes it will affect it.

You can kill time by looking for a job, applying but not actually working of course.
You can request an expedite after day 75 if you can document that you have a job offer.
Meanwhile focus on your resumes, DMV booklet to study
for the driver's test etc.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I thought that would be the case, but I've seen people who applied for AOS after I did, and had an RFE yet received their EAD a month ago, some even already have their GC!

I've been trying to work on my resume for the past 2 weeks and I'm getting no-where which is incredibly frustrating. I looked into applying for work before I get my EAD but was informed that I couldn't even APPLY for work until my EAD has been approved - I'm guessing this isnt the case? Although I'd hate to be offered a job but unable to start work because I don't have my EAD yet. (Not that I seem to be able to form a resume anyway!)

Also I wont need to take the driving test as I had a 1 year NC licence when I was on the J1 visa last year, so I got my temp GA licence without needing a test and will not need to take a test when I get a proper licence (when I get my EAD).

Don't start to worry until after 90 days. Times are currently trending around 70 days.

From other threads it seems that USCIS don't update EAD/AP status that often.

Hold tight, you may be close.

(ETA) edited to add: The worst thing you can do is compare your case to others. It will only add stress. Remember, each case is unique.

My status too changed to " my case is ready to be scheduled for interview" on may 11 and i have not received my interview date yet. Let me knw when you have your interview date. I will also update u too wen i have my interview date.
