My husband, the beneficiary, has a child from the firs marriage for which he pays child support. The child is not immigrating and does not live with the beneficiary.

Our I-130 is approved, waiting for the interview to be scheduled. Do we need to worry about proof of payments up to date or proof that we have arranged to pay child support from the US already? We were not planning on changing the way he pays until his visa is issued in case of long administrative processing.

My immigration journey

July 2009 - F1 student PhD program

AOS
June 2010 - married USC

August 2010 - sent I-130 and I-485

December 2010 - CGC received.
December 2010 - ex-husband got crazy
May 2011 - separated
November 2012 - divorced!!

I-751 waiver

October 13 - filed I-751 waiver by myself
November 28 - BIO & InfoPass to submit a divorce decree

December 2012 - CGC expires

May 3 2013 - RFE received, asked for a divorce decree (haha) and address clarification + more evidence

July 6 2013 - RFE mailed and received

September 2013 - InfoPass, passport stamped to extend my status

November 2013 - Finally an interview is scheduled
December 12 2013 - Interview. Approved without any questions, passport stamped. Same officer who did my initial interview (I was told "I saw it coming, don't give up on love" :) )

December 27 2013 - Card received, too bad I was overseas

January 2014 US entry, special screening, but admitted instantly once I got to speak to the officer. It's a standard procedure if no valid GC on hand.

July 2015 - MARRIED in Russia

N-400

October 2015 - N-400 sent

February 2016 - interview and test

March 2015: USC!

DCF for my husband

April 2016: InfoPass to file I-130 in Moscow, approved on the same day.

May 2016: DS-260 interview - AP for "dangerous" work field

July 2016: visa issued! 59 days in AP.

May 2018: filed I-751 

June 2018: 18 months extension received

I traveled all over the world in the meantime, no problems with visas and entries, occasionally some explaining and more documents to haul around.

No I don't have a link on that. The US doesn't care how your husband plans on paying child support in Russia. Now if Russia cares I wouldn't know..

They do. If he owes child support or has any unpaid traffic tickets, they won't let him out of the country.

So you might want to ask this question of the embassy in Russia and what their local requirements are.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

They do. If he owes child support or has any unpaid traffic tickets, they won't let him out of the country.

That's an exit control issue for Russia, it has no bearing on whether or not the US Embassy will issue him a visa.

I thought if he was behind on the payments they can't leave the country. We are in the same boat and trying to cover everything before we file.

"WHO DOES NOT GO ABROAD?

Russian legislation is already quite a long time and fully defined list, according to which certain categories of persons and prohibits them it is impossible to go abroad with debt. It debtors who are in arrears on payments of alimony, taxes, loans, fines, plus house arrest abroad is provided to those citizens who have debts to pay for services of housing and communal services and other irresponsible citizens. However, if there are valid reasons for non-payment of debt in time of a particular type, you can withdraw permission, according to article 67 of the Law "On Enforcement Proceedings", the restriction on visits to foreign countries."

Sent to DOS: New Website: July 18th 2018. Old website July 17th (Case number was finally found after 206 days of submitting petition, appeared on July 29th.)

Received NVC: July 24th 2018, per calling NVC option 5.

Fees paid August 21st 2018. Marked as paid on August 23rd 2018.

Case Complete: September 11th 2018 via website 
Received Interview data: From embassy Oct 13, from NVC: Oct 15th.
Interview: originally Nov 27th, rescheduled to Nov 29th.

Interviewed on Nov 29th, was told everything is good, asked for CV / resume, kept passport.

Nov 29th Email submitted.

Nov 30th They sent us an email for a physical copy.

Dec 3rd Submitted. Dec 4th They received.

Dec 7th, 14th,18th, 19th, 20th case was touched.

Dec 21st ready for Pick up. Dec 23rd pick up passport with no visa.  Was told due to holidays they resent passport incase Husband needed it, and to return it back on Jan 9th.

Jan 15th, sent off passport back to Embassy, Jan 16th case updated and received passport. 
Jan 24th case touched. Feb 1st sent email asking if they needed anything from us, replied Feb 5th stating still going thru AP, no change on website. Feb 13th, case was touched. March 5th sent email (not by travel docs) asking what we are waiting on, received auto email, unsure if case touched was touch per auto email.
March 5th, 7th case was touched. Also UStraveldocs passport states "There is no status update available for the passport number submitted"

March 15 Sent message via ustraveldocs about what's going on etc etc.
March 19: reply from Embassy Stating we have been approved and should get visa in 1-2 business days! 

March 20th: Issued!!!!! ViH: March 21st.
POE: Aiming for April 26th.

ROC (LA, CA Area): sent  April: 12th 2021, Case transferred June 17th. Bios Jan 4th 2022. Ready for schedule interview Jan 5th 2022. Interview scheduled on Jan 11th 2022 for Feb 18th 2022. Approved at interview. Green card sent Feb 23rd 2022. Green Card in hand Feb 28th 2022. 
Next N-400: Submitted May 27th 2023, bios being reused. 

IR-2 (Step daughter, Ukraine): Sent June 7th, 2021 via online. Case was actively being looked at since Nov 2nd 2021. Approval Feb 16. Case sent to NVC Feb 19th 2022. Interview Dec 17, VIH 18th, POE Dec 26th 2022.
