Hi, well my bad news for the night

I read on here over the weekend the I-129 form was expired on the 18th of Feb, and of course I sent mine in on the 23rd. When I checked the form (saved in my computer) of course it is the wrong date. sigh.

I did get back my receipt today, so while this made me happy, I was unsure to call and say, ops missed the date on the bottom of the form, or if I should let lying dogs sleep (i love backwards ok).

What do others say? Should I call and let them know, assuming in 4 weeks they will reject it and then tell me?

Or should I wait?

It's not the USCIS's problem, it's the filer's problem. Frequently, expired forms will, in fact, be returned. Perhaps the OP's package will reach a particularly forgiving soul - which I hope happens - but they tend to take these baseline requirements pretty seriously.

Don't worry, I think you just misunderstood the info. The current version is dated 11/24/06 and is now being accepted. the old version was dated 5/23/06 and was also being accepted until 2/18/07. It looks like they had a grace peroid where both editions were accepted, but that has passed. Check this link for the latest info:

Well, I just realized I'm in the same boat. It took me a few weeks to gather all my info, and I used the older I-129F that stopped being accepted on 2/18/07. I filled it out at the end of January, but didn't send everything in until Feb 27th. NINE DAYS LATE!

I guess the only thing to do is keep fingers crossed and hope that it's still processed, or at the very least, they get back with a quick response. I'd hate to wait three months only to have these jokers tell me I need to start all over again. In that spirit, does anyone know if they make you start from the beginning if you accidentally use an expired form? Or do they just send an information request?

The semi-good news is that looking at the new form, it appears to be the exact same thing as the old one. I didn't compare them side by side, but looking at the new form, I didn't see any big format changes or new information. So it's not like you are depriving them of vital info they are now relying upon.

On a side note, I never really understood why people hate the government so much until now. It's infuriating that something so personal can be relegated to a lethargic, unresponsive bureaucratic process. It's equally infuriating that if you are a citizen of one state or another, the treatment you get (i.e. speed of the process) is radically different. So much for all citizens being equal in the eyes of the government.

Sorry for the ranting. It's just been one of those days where it seems like good news will never come. And here I am, only a couple weeks past my NOA1.

I sent in an expired form in October, and they did NOT send me a NOA1. They returned my entire file (now secured with two holes punched in the top and secured with the metal thingy) with request for me to send in the updated form. I re-sent it in that very day and they immediately sent my NOA1.

I was lucky enough to get mine in before the expiration date, but the only difference I could find is on the question that asks something like have you ever been accused of ... and listed like 3 crimes. They added a box to check no. Kind of silly to cause such a ruckus over a check no box, but hey, as said, is the US government! Ok, maybe not so silly since I was thinking, I didnt do any of these and I want to check no... Haha

Having worked for Govt before (nothing so glamorous though) I know the attitude. But for now, I say nothing and make the symbol of the cross and say GO IN PEACE to these people, (like a catholic thing)

Now the post office, me and them have a bone to pick LOL.......

There is no way to realize that the form version you sent is acceptable, until you receive the NOA-1. I believe that you will.

If not, they will reject the package and return it to you. Don't worry about it now, just keep tracking your online USCIS status.

Good news is; it will be a couple of weeks lost and that's it. You can register on the USCIS website and check your the back of your cashed check for a case #. That will let you know if/when they gave NOA1.

In the meantime just have the new one ready to mail USPS return receipt requested.
