Hi,

Here I need advice,I come to usa on cr-1 visa the end of the Jan, 2016.

Now I go back to my country bcoz of some reason and Dont want to back here. If I surrender my conditional green card then what happen? Is it possible?

And what happen after this if I wish to come in usa?

For how long do you need to return to your home country? Why do you wish to surrender your green card instead of acquiring a re-entry permit?

It's been less than a month, you may want to give it some time or even discuss with your spouse about moving to a warmer area of the USA.

That being said, yes, you can give back your greencard. Return home and once you are back home, contact your local US embassy and send them the greencard, explaining you have decided not to become a permanent resident. If you want to visit the USA later, you can apply for a tourist visa; it should be easy to get as you voluntarily handed back the greencard.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I'm sorry that you're so unhappy that you're already wanting to move back home. Not to be mean, but this is what happens when you don't communicate. I don't understand how this issue with hot and cold weather didn't come up earlier in your relationship?! Where to live was one of the first things my husband and I talked about when we got serious and started planning a life together.

You're in an unhappy place right now and that's the worst time to be making life altering decisions. Not to mention that a month is not near enough time to adjust to a new country, a new culture and a new climate. I think you owe it to your spouse, your families and yourself to at least give your new life a chance, or you might come to regret it later. :( You say that the climate is very difficult for you and your health. But that's one of the wonderful things about the US, you get all kinds of weather there. If you don't like it in New Jersey, and I can't say that I blame you :), there are thousands of other places to move with much nicer weather.

If you give back your green card and go back home, that's it. All the time, money and effort you put into the visa process will have been for nothing. And you give up on your spouse too.

This is a little unfair. Two people can communicate for years prior to arrival in North America and still not be prepared for it. Some people easily adapt to the winter cold, some simply cannot. My wife, before we were married was able to visit me in Iowa in March. It was horrible for her. After we married I moved to New Mexico, and she arrived here last July. Even in this "warmer" climate, she has not been able to adapt to NM winter. And I'm not sure she ever will.

When I moved country for the first time, to Vancouver Canada, I hated it for the first three months even though I had wanted to live there since I was ten years old. After three months and when I got my job I started to like it there and eventually loved it. In the end I got homesick for Vancouver when we had to move away.

Give it a couple more months, the weather should be improving?

Have you told your spouse how you feel, maybe they can help or have suggestions of coping with the cold? I am not used to hot weather but my husband is so he gives me tips on how to feel better.

Im half Scottish, half Irish, fair skin, freckles, red hair. I HATE HATE HATE hot weather. Heck, I hate warm weather. Im all about the Fall and Winter. Summer in Mississippi is a killer for me. 110 degrees for someone who thinks 60 degrees is too hot can make one very miserable. I have done it for over 3 years now AND endured the endless mosquito bites (they seem to love British blood). But the weather is NOT A deal breaker if it means your lucky enough to spend the rest of your life with someone you truly love. So Im assuming there is something running a lot deeper here for OP. Home sickness can be overwhelming...... maybe this is the root of the unhappiness in general? I hope you guys can work through this. And hey, if you hate the cold weather so much I will happily trade places with you. I would love to live somewhere cold :content:

Growing up with my did in the Air Force and my late husband with IBM (means i've been moved) i have lived in 24 states.

This being said i thought i had experienced all kinds of weather but the 2 story snowfalls at Owego and tunneling under them to get from one college building to another was a bit much and i trnsfered to Cornell (still in the snowbelt) promising myself to move south when i could. Stay and promise yourself to do this and enjoy the NJ beaches this summer. Maybe your financee is not able to move at this time but you made the promise and committment for them to apply for your visa with the promise of love and marriage. this means a lot to most of us so we urge you to not give up. Sorry but NJ itself is a cultural shock but i would have thought the traffic would be the issue and the cost of car insurance among other things i have lived there myself / make a promise and work towards getting to a more favorable area for your needs but keep your financee in mind. Love and be loved and buy a goose down coat

I 407 I think is the form, send it is when you get back to India.

this is a really cold winter:( you should have came in the summer lol but it will be so much nicer!! you just got here.. do you have a job yet? are you settled? i would really think twice and find activities you guys can do together indoors haha the winter can be a fun time;) hot chocolate, watching tv indoors (where you will work on your american english!)

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
