when you cross the border through POE (especially border towns where the traffic both ways is heavy for day trips) theyy say "citizenship" and you say what it is.. she probably said "American" thinking, well i am living in america. This was probably pre-passport when you almost didnt even need ID they just waved you in and perhaps her "accent" or something tripped them up.

I agree though, she should clear up that matter and find out what exactly the case is, but it doesnt look good:/

Honestly I would quit the tourist visa thing. She lived here as an illegal and that's a ban right there. What I would do is as soon as your mom can get her citizenship, to file a petition for your sister

If, however, the daughter did indeed claim (or try to claim) to be a USC when coming back from Canada, there is NO waiver available for an immigrant visa.....and only a very remote chance of a nonimmigrant visa waiver and then only if said daughter overcomes the presumption of immigrant intent....a lot of 'ifs'....

As we know very little about the sister it is impossible to say what non immigrant options may be open to her.

Any NIV that she might apply for, which is subject to 214b (B2, F1, H2B, H3, P1, J1 for ex), will present two problems (assuming she is ineligible under 212 6 C (ii) - (1) overcoming 214b and (2) asking for, then receiving a 212 d 3 a waiver for that ineligibility....

Other NIVs, like the H1B, have stricter requirements, but she would still need a waiver (if ineligible)
